rr 2 5 1992 COMMUNITY CENTER LEASE AGREEMENT This agreement, is made thisqj'/ day of , 1992, between the City of Moscow, a municipal corporation of IdahoXue5£or), and the Retired Senior Volunteers Program (Lessee), to wit: The Lessor hereby agrees to lease to Lessee certain areas within the Moscow Community Center located at Third and Washington Streets in Moscow Idaho, subject to the following covenants, rt:servations and conditions: 1. TERM. This lease shall be effective for a period of one ( 1) year commencing on October 1, 1992, and terminating on September 30, 1993. 2. LEASED PREMISES. Lessee shall have the full use of the following premises for the period of this Agreement a. An unspecified office space 3. RENT. The Lessee hereby agrees to provide staffing for the Community Center in lieu of cash rent. Lessee further agrees that such staffers shall not be considered employees of the Lessor, and that Lessee shall hold harmless and indemnity the Lessor for any claims or damages, of whatever nature, arising from such staffing and/or the actions of said staffers. 4. TELEPHONE SERVICE. Lessee shall be responsible for the installation, maintenance and revolving service charges for telephone service to its office space. 5. TERMINATION. The parties reserve the right to terminate this agreement without penalty upon FIFTEEN ( 15) days written notice to the other party. 6. SUSPENSION. This agreement shall be suspended if said premises are damaged or destroyed. Said suspension will continue until such time as the premises are restored, but in no case shall such suspension extend beyond the termination date of this agreement. 7. INSURANCE. Lessee agrees to provide general liability insurance in the amount ofFIVE HUNDRED THOUSAND DOLLARS ($500,000.00) for activities related to its used of the premises, and further shall include the City of Moscow as a named insured under said policy of insurance. Lessee LEASE AGREEMENT PAGE 1 ---PAGE BREAK--- further agrees to hold the City of Moscow, its agents, servants, employees, officers and contractors harmless from any and all claims, causes of action or damages which may arise from Lessee's use of said premises. 8. ADDRESSES. All notices or other written communications required by this agreement shall be deemed served by certified mailing of notice through the United States Mail to the other party at the following address: City of Moscow P.O. Box 9203 Moscow, Idaho 83843 Retired Senior Volunteers Program 1424 Main Lewiston, Idaho 83501 9. ANTI-DISCRIMiNA0.fiON. Lessee agrees that it shall not discriminate as to the use of the premises, or in employment, on the basis of age, sex, race, religious affiliation or handicap. Lessee agrees to conduct its operations in compliance with all applicable laws, ordinances and regulations of all applicable government agencies boards or departments. 10. ASSIGNMENT. Neither this Agreement nor the premises may be assigned by the Lessee. 11. INSPECTION. Lessor, by its duly authorized representatives or officials, shall have access at all times to examine and/or inspect the premises. 12. DEFAULT. IfLessee shall default in the performance of any provision of this Agreement, and such default is not remedied within TEN (1 0) days after receipt of writte¿ notice thereof by the Lessor to the Lessee, or if the Lessee shall abandon the premises, the Lessor may terminate this Agreement upon written notice to the Lessee and further may exercise any remedy allowed by law to enter upon and take possession of said premises and shall hold Lessee responsible for damages by reason of such default. 13. CONDITION OF PREMISES/WASTE. Lessee accepts the premises in the present condition, and Lessor shall be under no obligation to repair, maintain or improve the premises for the benefit of the Lessee during the term of this Agreement. Upon termination of this Agreement, Lessee shall restore the premises to the condition they were in at the beginning of this Agreement, and shall repair any damages to the premises stemming from Lessee's use of the premises. Lessee further agrees that Lessee shall not alter the premises, either temporarily or permanently. LEASE AGREEMENT PAGE2 ---PAGE BREAK--- . .
