RESOLUTION 2003 -01 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPLE CORPORATION OF THE STATE OF IDAHO, AUTHORIZING THE AMENDMENT OF THE COMPREHENSIVE PLAN LAND USE MAP (FIGURE 8) TO REDESIGNATE PROPERTY COMMONLY KNOWN AS THE LATAH COUNTY COURTHOUSE PARKING LOTS LOCATED ON THE EAST SIDE OF S. VAN BUREN ST. AND SHOWN AS PARCEL 2 ON EXHIBIT FROM MEDIUM DENSITY RESIDENTIAL (MR) TO PUBLIC AND THE AMENDMENT OF THE COMPREHENSIVE PLAN LAND USE MAP (FIGURE 8) TO REDESIGNATE PROPERTIES COMMONLY KNOWN AS THE FIRST PRESBYTERIAN CHURCH LOCATED AT 405 S. VAN BUREN ST. AND THE NORTHWEST CORNER OF THE MOSCOW HIGH SCHOOL PROPERTY LOCATED AT 402 E. 5TH. ST. AND SHO\VN AS PARCEL 3 AND PARCEL 4A RESPECTIVELY ON EXHIBIT FROM HIGH DENSITY RESIDENTIAL (HR) TO PUBLIC; PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, the existing uses on the subject properties are not residential and are not anticipated to be converted to residential uses, and the existing uses on the subject properties are predominately public service and institutional uses; and WHEREAS, the subject properties are adjacent and to the east of existing commercial uses and are in close proximity to the east of the Central Business (CB) Zoning District; and WHEREAS, the Public Services, Facilities and Utilities Element of the Comprehensive Plan states that governmental and other facilities serving the public are most appropriately located in the eastern portion of the Central Business District and the areas adjacent to the east; and WHEREAS, the Planning and Zoning Commission held a public hearing on this matter on September 25, 2002; and WH.EREAS, the Mayor and City Council held a public hearing on this matter on December 16, 2002 and concluded that the subject properties are suitable for the Public Land Use designation; and WHEREAS, Idaho Code Section 67-6509 requires that the Planning and Zoning Commission not recommend to the City Council Comprehensive Plan Map amendments more frequently than once every six ( 6) months. NOW, THEREFORE, BE IT RESOI,VED hy the Mayor and Council of the City of Moscow, Idaho as follows: That the Comprehensive Plan Land Use Designation of the property commonly known as the Latah County Courthouse parking lots located on the East side of S. Van Buren St. and shown as Parcel 2 on Exhibit attached hereto and incorporated herein by this reference be changed from Medium Density Residential (MR) to Public and that the Comprehensive Plan Land Use Map (Figure 8) of the Moscow Comprehensive Plan be so amended and that the Comprehensive Plan Land Use Desi!,'Ilation of the properties commonly known as the First Presbyierian Church located at 405 S. Van Buren St. and the northwest comer of the Moscow High School property located at 402 E. 5th. St. and shown as Parcel 3 and Parcel 4A respectively on Exhibit attached hereto and incorporated herein hy this reference be changed from High Density Residential (HR) to Public and that the Comprehensive Plan Land Use Map (Figure 8) of the Moscow Comprehensive Plan be so amended. Comprehensive Plan Land Use Designation change from Medium Density Residential (MR) to Public B. Rezone from Multiple Family Residential (R-4) to General Busmess (GB) Parcel 3 (First Presbyterian Church): A Comprehensive Plan Land Use Designation change from High Density Residential (HR) to Public B. Rezone from Multiple Family Residential (R-4) to General Business (GB) Parcel 4 (Moscow High School): Rezone from Multiple Family Residential (R-4) to General Business (GB) Parcei4A (NW comer of Moscow High School property): A. Comprehensive Plan Land Use Designation change from High Density Residential (HR) to Public B. Rezone from Residential/Office (RO) to General Business (GB) ParcelS (1912 Center Property) Rezone from Multiple Family Residential (R-4) to General Business (GB) The Moscow Planning and Zoning Commission has recommended that the City Council deny the Comprehensive Plan Land Use Designation amendment and the rezoning proposal listed above.
