t' RELEASE OF COVENANT AND AGREEMENT TO HOLD PROPERTY AS ONE PARCEL (LOT TIE AGREEMENT) #-51i1os 579565 NO_N_-;::;:-:OPQRS T A T THE REQUEST OF f'-1rvq;::-m4rcd` /'5ATE & HOUR ffe . :J9 : I H'§:JruANNE WES"fOEFt(ifr= -,cc COUN THIS IS A RELEASE OF THE "COVENANT AND AGREEMENT TO HOLD PROPERTY AS ONE PARCEL", that was entered into the 8th day of April, 2016 by and between the City of Moscow, Idaho, a municipal Corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho, 83843 (hereinafter "CITY"), and Cody Merrell (Merrell Enterprises IV LLC, and Merrell Enterprises VI LLC), owner of property located at 1912 and 2020 White Avenue, Moscow, Idaho, 83843 (hereinafter "DECLARANT"); W I T N E S S E T H: WHEREAS, CITY and Property Owner (Declarant) entered into a Covenant and Agreement to Hold Property as One Parcel (hereinafter "Lot Tie Agreement") on the gth day of April, 2016; and WHEREAS, DECLARANT certifies that he owns the real property known as parcels 2 and 3 located in a portion of Lot 26 of the Plat of Section 16, T. 39 N, R. 5 W, B.M., as fully described within the attached legal descriptions, located in the City of Moscow, State ofldaho, and as shown on the attached EXHIBIT and WHEREAS, this property, known as parcels 2 and 3 located in a portion of Lot 26 of the Plat of Section 16, T. 39 N, R. 5 W, B.M., as fully described within the attached legal descriptions, located in the City of Moscow, State ofldaho, is located at and is known by the following ADDRESSES: 1912 White Avenue Moscow, Idaho, 83843; and 2020 White Avenue Moscow, Idaho, 83843; and WHEREAS, both lots are collectively referred to as "the Property"; and WHEREAS, the DECLARANT was proposing a development project that required a Lot Tie Agreement for the purpose of creating a single building site; and WHEREAS, the DECLARANT has since submitted application for and has been approved for a lot line adjustment that satisfies all Zoning and Building Code requirements for the proposed project; and WHEREAS, the Lot Tie Agreement may be terminated based on a determination by the Zoning Administrator of CITY that the Lot Tie Agreement is no longer required; NOW, THEREFORE, CITY hereby covenants the following: 1. This Lot Tie Agreement is released based on a determination by the Zoning Administrator that with the approved lot line adjustment, the Property and proposed development will be in compliance with the applicable Zoning Code, ordinances and regulations of CITY or other laws, and the Lot Tie Agreement is no longer required; and RELEASE OF LOT TIE AGREEMENT - CITY AND CODY MERRELL PAGE 1 OF3 z_o \ lP - D 4 2- ---PAGE BREAK--- 579565 2.
