WAIVER OF CLAIM Myrna M. Bergman and Jessica S. Bergman 1'-/i'f c WHEREAS, the undersigned Myrna M. e man and Jessica S. Bergman are owners of property commonly known as 1je8 ast F Street, Moscow, Latah County, Idaho; and WHEREAS, Myrna M. Bergman and Jessica S. Bergman purchased such property from Carol Bradford-Gable; and WHEREAS, Myrna M. Bergman and Jessica S. Bergman are aware of a claim (attached hereto as Exhibit the same as if fully transcribed and copied herein) by Carol Bradford against City of Moscow, Idaho, for the return of a large culvert squash pipe formerly installed in the City right-of-way in front of 1408 East F Street; and WHEREAS, Myrna M. Bergman and Jessica S. Bergman are aware of and understand claims contained within claim and amended complaint in the Amended Small Claim Case No. CV00-00059 filed in the District Court of the Second Judicial District of the State of Idaho, in and for the County of Latah; and WHEREAS, Myrna M. Bergman and Jessica S. Bergman do not wish to make any claim against City of Moscow, Idaho for the return of said squash pipe; and WHEREAS, Myrna M. Bergman and Jessica S. Bergman do not desire to make any claim against City of Moscow related to said squash pipe or related to claims contained in the Amended Small Claims Case No. CV00-00059 filed in the District Court of the Second Judicial District of the State of Idaho, in and for the County of Latah; and WHEREAS, Myrna M. Bergman and Jessica S. Bergman wish to waive and hereby do waive any and all actions, causes of action, claims, demands, damages, costs, loss of services, expenses and compensation against City of Moscow, Idaho, its agents, servants, employees, officers, directors and attorneys, whether named herein or not related to, on account of, or in any way growing out of the installation and/or removal of a squash pipe in the City right-of-way adjacent to 1408 East F Street, Moscow, Latah County, Idaho. NOW, WHEREFORE, premises considered, Myrna M. Bergman and Jessica S. Bergman do agree to the following: WAIVER OF CLAIM Page 1 of 3 ---PAGE BREAK--- The undersigned, Myrna M. Bergman and Jessica S. Bergman do hereby waive, release, acquit and forever discharge City of Moscow, Idaho, its agents, servants, employees, officers, directors and attorneys whether named herein or not, all and each of them, of and from any and all actions, causes of actions, claims and demands, damages, costs, loss of services, expenses and compensation on account of or in any way growing out of claims against the City for the return of the above-described squash pipe, all as more fully described in the Amended Small Claim Case No. CV00-00059 filed in the District Court of the Second Judicial District of the State of Idaho, in and for the County of Latah. IT IS EXPRESSLY WARRANTED by us that no promise or inducement has been offered except as set forth herein; that this Waiver of Claim is executed without reliance upon any statement or representation of any person or parties released or their representatives concerning the nature and extent of the injuries, damages and/or legal liability therefor; and that acceptance of the consideration set forth herein is in full accord and satisfaction of all disputed claims as set out above. . ,,fit WITNESS MY HAND on th1s -r day of I1 ,2000.
