ORDINANCE NO. 1011 AN ORDINANCE VACATING THAT PART 'OF FOURTH STREET IN THE CITY OF MOSCOW LYING AND BEING BETWEEN THE WEST LINE OF V .AN BUREN STREET AND A POINT ONE HUNDRED THIRTY-FIVE (135) FEET WEST OF SAID WEST LINE DF V PN BUREN STREET, IN THE CITY OF MOSCOW, COUNTY OF LATAH, STATE OF IDAHO; AND PROVIDING THAT SAID VACATION SHALL BE SUBJECT TO THE RIGHT OF THE CITY OF MOSCOW TO MAINTAIN AND REPAIR OR REPLACE UTILITIES; AND PROVIDING THAT THE STREET SO VACATED SHALL REVERT TO THE OWNERS OF THE ADJACENT REAL PROPERTY IN THE MANNER PROVIDED BY SECTION 50-1124 OF THE IDAHO CODE; AND PROVIDING FDR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHOz Section 1. That that part of Fourth Street in the City of Moscow lying and being between the West line of Van Buren Street and a point one hundred thirty-five (135) feet West of said West line of Van Buren Street, situated in the City of Moscow, County of Latah, State of Idaho, that part of Fourth Street being vacated being more particularly described as follows, to wit: Beginning at the Southeast corner of Block Three of Russell's Addition to the City of Moscow, as shown by the recorded plat thereof, and running thence West a distance of one hundred thirty-five (135) feet along the South line of said Block Three thence South a distance of eighty (80) feet to a point on the North line of Block Four of said Russell's Addition, thence East a distance of one hundred thirty-five (135) feet to the Northeast corner of said Block Four thence North a distance of eighty (80) feet to the point of beginning, be, and the same is, hereby vacated; subject, however, to the condition that the employees of the City of Moscow and of all private corporations, including the General Telephone Company and the Washington Water Power Company, their successors and assignees, shall have the right to enter onto such vacated area for the purpose of maintaining, repairing, or replacing their respective utilities now in place within the area vacated. Section 2. That the street so vacated shall revert to the owners of the adjacent real property, as provided by Section 50-1124 of the Idaho Code, subject to the rights of the City of Moscow set forth in Section 1 above. Section 3. This ordinance shall be in full force and effect from and after the date of its passage, approval and publication. PASSED by the Council and APPROVED by the Mayor this fourth (4th) day of January, 1960.
