ORDINANCE NO. 1054 AN ORDINANCE ACCEPTING AND CONFIRMING ON BEHALF OF THE CITY OF MOSCOW A RIGHT-OF-WAY FOR STREET PURPOSES THE DEED OF DEDICATION AS HERETOFORE MADE BY THE MOSCOW SCHOOL DISTRICT NO. 281 ACROSS THE FOLLOWING-DESCRIBED PROPERTY SITUATED IN LATAH COUNTY, IDAHO, TO WIT: LOT FIVE AND LOT TWELVE (12) IN KINGS ADDITION 1D THE CITY OF MOSCOW, AS SHOWN BY THE RECORDED PLAT THEREOF, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS, TO WIT: BEGINNING AT THE NORTHWEST CORNER OF LOT FIVE IN KINGS ADDITION TO THE CITY OF MOSCOW, IDAHO, AS SHOWN BY THE RECORDED PLAT THEREOF, AND RUNNING THENCE SOUTH EIGHTY-EIGHT DEGREES (88°) THIRTY MINUTES (30') EAST A DISTANCE OF EIGHTY AND ONE HUNDREDTH (80. 01) FEET TO THE NORTHEAST CORNER OF SAID LOT FIVE THENCE SOUTH A DISTANCE OF THREE HUNDRED FORTY-TWO AND FORTY-SEVEN HUNDREDTHS (342.47) FEET ON THE EAST LINES OF LOTS FIVE AND TWELVE (12) IN SAID KINGS ADDITION TO THE SOUTHEAST CORNER OF SAID LOT TWELVE (12) , THENCE NORTH EIGHTY-NINE DEGREES (89°) TWELVE MINUTES (12') WEST A DISTANCE OF EIGHTY (80) FEET TO THE SOUTHWEST CORNER OF SAID LOT TWELVE (12), THENCE NORTH A DISTANCE OF THREE HUNDRED FORTY-THREE AND FORTY-FIVE HUNDREDTHS (343.45) FEET ON THE WEST LINES OF SAID LOTS TWELVE (12) AND FIVE TO THE POINT OF BEGINNING; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: SECTION 1. That the City of Moscow, Idaho, accepts and confirms, pursuant to Section 50-1142 of the Idaho Code, a right-of-way for street purposes that Deed of Dedication heretofore made by the MOSCOW SCHOOL DISTRICT NO. 281 to the City of Moscow, Idaho, across the following-described property situated in Latah County, State of Idaho, to wit: Lot Five and Lot Twelve (12) in Kings Addition to the City of Moscow, as shown by the recorded plat thereof, and more particularly described as follows, to wit: Beginning at the northwest corner of Lot Five in Kings Addition to the City of Moscow, Idaho, as shown by the recorded plat thereof, and running thence South eighty-eight degrees (88°) thirty minutes (30') East a distance of eighty and one hundredth (80.01) feet to the northeast corner of said Lot Five thence South a distance of three hundred forty-two and forty-seven (342.47) feet on the east lines of Lots Five and Twelve (12) in said Kings Addition to the southeast corner of said Lot Twelve (12), thence North eighty-nine degrees (89°) twelye minutes (12') West a dlstance of eighty (80) feet to the southwest corner of said Lot Twelve (12), thence North a distance of three hundred forty-three and forty-five hundredths (343.45) feet on the west lines of said Lots Twelve (12) and Five to the point of beginning. SECTION 2. That upon the passage of this ordinance that the area described in Section 1 above shall be deemed a public street and shall be under the use and control of the City ---PAGE BREAK--- Council of the City of Moscow, Idaho. SECTION 3. This ordinance shall be in full force and effect from and after the date of its passage, approval and publication.
