25130 ORDINANCE NO. 1363 AN ORDINANCE ANNEXING CERTAIN LANDS PARTICULARLY DESCRIBED IN SECTION 2 OF THIS ORDINANCE OF THE CITY OF MOSCOW, IDAHO; PROVIDING THAT THE CITY MAP AND THE COMPREHENSIVE PLAN OF THE CITY OF MOSCOW, IDAHO, BE AMENDED ACCORDINGLY AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: WHEREAS, the land described in Section 2 of this Ordinance is land lying adjacent to the City of Moscow, Idaho; and whereas said land is in- tended and can reasonably be assumed to be used for the orderly development of the City of Moscow, Idaho; and whereas the owners of said land have re- quested in writing of the Council of the City of Moscow, Idaho, that said land be annexed to the City of Moscow, Idaho: SECTION 1. ANNEXATION. That the land described in Section 2 of this Ordinance be and the same hereby is annexed to the City of Moscow, Idaho, and that said land be and the same hereby is declared a part of the City of Moscow, Idaho. SECTION 2. DESCRIPTIONS. That the land annexed to and declared to be a part of the City of Moscow, Idaho, by this Ordinance is situated in Latah County, State of Idaho, and is more particularly described as follows, to- wit: A tract of land located in the Northeast Quarter (NE 1/4) of the Southeast Quarter (SE 1/4) of Section Eight Township Thirty-nine (39) North, Range Five West, Boise Meridian, more particularly described as follows, to-wit: Beginning at the Quarter corner on the East side of Section Eight Township Thirty-nine (39) North, Range Five West, Boise Meridian, and running thence South 45° 21' 55" West 42.16 feet, more or less, to a point of intersection of the South right-of-way line of Street and the West right of-way line of Mountain View Road, all in the City of Moscow, Idaho; thence South, along said West right-of-way line of Mountain View Road, 212.00 feet to the TRUE POINT OF BEGIN NING of this description and from this TRUE POINT OF BEGIN NING continuing South along said West right-of-way line 342.66 feet; thence leaving said West right-of-way line and running North 899 27' 00" West 830.42 feet; thence North 0° 041 07" East 447.03 feet; thence North 89° 55' 56" East 145.00 feet; thence North 0° 04' 07" East 108.16 feet to a point on said South right-of-way line of Street; thence South 89° 16' 38" East, along said South right-of way line, 409.79 feet; thence leaving said South right-of way line and running South 0° 06' 22" West 215.80 feet; thence North 89° 55' 56" East 275.40 feet, more or less, to the POINT OF BEGINNING. Said tract contains 8.879 acres, more or less. ---PAGE BREAK--- Township Thirty-nine (39) North, Range Five West, Boise Meridian and more particularly described as follows: Beginning at a point on the East boundary line of Section Eight Township Thirty-nine (39) North, Range Five West, Boise Meridian said point being 1283.51 feet South 0° 00' from the Northeast corner of the SE 1/4 of said Section Eight and thence North 90° 00' West a distance of 275.35 feet, to the true point of beginning; thence South 0° 00' a distance of 404.10 feet to a point; thence North 90° 00' West a distance of 317.00 feet to a point; thence North 0° 00' West a distance of 239.70 feet to a point; thence South 89° 34' East a distance of 140.0 feet to a point; thence North 0° 00' a distance of 108.0 feet to a point; thence North 89° 34' West a distance of 20.0 feet to a point; thence North 0° 00' a distance of 56. 40 feet to a point; thence North 90° 00' East a distance of 197.0 feet more or less to the true point of beginning. SECTION 3. The City Engineer of the City of Moscow, Idaho, be and is hereby ordered and directed to make the necessary amendments to the Official Zoning Map and Comprehensive Plan of the City of Moscow, Idaho, which map and plan are on file at the City Hall at the City of Moscow, Idaho to provide that said area is to be henceforth a part of the City of Moscow, Idaho. SECTION 4. PUBLICATION. That this Ordinance shall be published in one issue of the official newspaper of the City of Moscow, Idaho. SECTION 5. EFFECTIVE DATE. That this Ordinance shall be effective from and after the date of its passage and approval and the publication thereof in the aforesaid official newspaper of the City of Moscow, Idaho. ADOPTED this sixth day of July, 1978.
