545161 PERMANENT PUBLIC UTILITY EASEMENT RECEIVED JUL 0 1 2011 City of Moscow MARK M. PICA and ROBYN L. PICA, husband and wife, GRANTORS, owners of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTEE, and its agents and assigns, a non-exclusive permanent easement and right-of-way in which to construct and maintain public utilities, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, as to wit: A permanent easement situated in Block 4 of the Anderson 1st Addition to the City of Moscow as shown on the attached 'Exhibit A' and being more particularly described as follows: Beginning at the southwest corner of Lot 14 of said Block 4; thence N04°03'52"W 13.88 feet along the west boundary of said Lot 14; thence N42°01'57"E 174.98 feet, parallel with and 10 feet distant of the boundary between Lots 14 and 15 of said Block 4 to the right-of-way line of Anderson Place; thence 21.21 feet along said right-of-way line, along a curve to the left having a radius of 45.00 feet, a central angle of 2r00'05", and a chord bearing S30°07'14"E 21.01 feet; thence S42°01'57"W 157.10 feet parallel with and 10 feet distant of said boundary between Lots 14 and 15; thence N86°51 '52"E 132.90 feet; thence N04°03'52"W 97.32 feet, parallel with and 15 feet distant of the boundary between Lots 15 and 16 of said Block 4 to the right-of-way line of Anderson Place; thence 30.59 feet along said right-of-way line, along a curve to the left having a radius of 45.00 feet, a central angle of 38°56'33", and a chord bearing N85°56'08"E 30.00 feet; thence S04°03'52"E 94.74 feet parallel with and 15 feet distant of said boundary between Lots 15 and 16; thence N75°18'32"E 171.17 feet; thence S14°41'28"E 5.50 feet to the south boundary of Lot 22 of said Block 4; thence S85°56'08"W 24.23 feet along said south boundary to the east boundary of Lot 17 of said Block 4; thence S04°03'52"E 29.48 feet along said boundary; thence S75°18'32"W 24.53 feet to the south boundary of said Lot 16; thence S85°56'06"W 305.91 feet along the south boundary of said Lots 16 and 15 to the point of beginning. Said easement contains 10,538 square feet, more or less. GRANTORS, their successors and assigns, reserve the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the public utilities. GRANTORS agree that they and their heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. The GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid utilities. Upon exercising these rights, GRANTEE shall restore the property to its prior condition. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes. It is expressly intended that the rights, burdens and restrictions contained in this Easement shall run with the land and shall bind GRANTORS AND GRANTEE, their heirs and assigns until such time this Easement is vacated by GRANTEE.
