ORDINANCE NO. 2003--07 AN ORDINANCE OF THE CITY OF MOSCOW, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO; PROVIDING THAT LAND DESCRIBED IN SECTION I OF THIS ORDINANCE, BE REZONED FROM AGRICULTURE/FORESTRY (AF) ZONING DISTRICT TO SUBURBAN RESIDENTIAL (SR) DISTRICT; PROVIDING THAT THE OFFICIAL ZONING MAP FOR THE AREA OF CITY IMPACT OF MOSCOW BE AMENDED ACCORDINGLY; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM THE DATE OF ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. W I T N E S S E T H: WHEREAS, the Moscow Planning and Zoning Commission held a duly noticed public hearing and recommended approval of this rezoning on March I2, 2003; and WHEREAS, the Moscow Mayor and City Council held a duly noticed public hearing on this rezoning on April 8, 2003; and WHEREAS, land described in Section I of this Ordinance is adjacent to land zoned Suburban Residential (SR) Zoning District; and WHEREAS, land described in Section I of this Ordinance is desioo'llated Low Density Residential (LR) on the Comprehensive Plan Map; and WHEREAS, the proposed SR zoning is in cont()rmance with the Moscow Comprehensive Plan LR desit,'llation; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO, AS FOLLOWS: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: The north four acres, more or less, situated uorth of the existing Suburban Residential (SR) Zoning District boundary line as shown on the Moscow Area of City Impact Map of the following described property: Commencing at the Southwest comer of Section 4, Township 39 North, Range 5 WBM and mnning thence East 330 feet; thence North I 320 feet; thence West 330 feet; thence South 1320 feet to the Place of Beginning. SECTION 2: ZONING. The land described in Section l of this Ordinance be and the same hereby is, rezoned from Agriculture/Forestry (AF) Zoning District to Suburban Residential (SR) Zoning District: and the City Engineer is hereby ordered and directed to make the necessary amendments to the official City map for the Area of City Impact of Moscow, Idaho, which is on file at City Hall. Provisions of this Ordinance shall be deemed severable and the invalidity of any provision of this Ordinance shall not affect the validity of remaining provisions. SECTION 4: EFF'ECTIVE DATE. This Ordinance shall be effective upon its passage, approval, and publication according to law. PASSED by the City Council and APPROVED by the Mayor this S'h day of April, 2003.
