PARTIES COOPERATIVE AGREEMENT NH-4114(062) MOSCOW COUPLET, SOUTH CON"NECTION KEYN0.2483 ROADWAY DESIGN REGISTER NO. _ _ THIS AGREEMENT is made and entered into this day 1999, by and between the IDAHO TRANSPORTATION DEPARTMENT, the STATE, and the CITY OF MOSCOW, hereafter called the CITY. PURPOSE The parties wish to establish the terms for the funding and acquisition of a parcel of land on US 95 related to the STATE's Project No. NH-4114(062), Moscow Couplet, South Connection, in the City of Moscow. This agreement will also provide for an easement over the parcel to the STATE. A drawing showing the parcel to be acquired, and the easement, is attached hereto as Exhibit A, and made a part of this agreement. Authority for this Agreement is established by Section 40-317 of the Idaho Code. The Parties agree as follows: SECTION I. That the STATE will: I. Assume no responsibility for the timely performance of this agreement. 2. Take all necessary steps to acquire the warranty deed for Parcel No. 2483107. That Warranty Deed shall be in the name of the CITY. A description of the parcel is contained on the blank warranty deed attached hereto as Exhibit B, and made a part of this agreement. 3. Provide funding in the amount of Two Hundred Thousand Dollars ($200,000.00) towards the acquisition of Parcel No. 2483107. The remainder of the funds necessary for the purchase will be the responsibility of the CITY. S!<:CTION II. That the CITY will: I. Within thirty (30) days of execution of this Agreement, pay to the STATE the amount of One Hundred Thirty Five Thousand Dollars 135,000.00), which is the total amount to be paid by the CITY for the purchase of Parcel No. 2483107. 2. Cooperate with, and authorize the STATE to acquire Parcel No. 2483107 in the name of the CITY. ---PAGE BREAK--- 3. Once the parcel has been acquired, provide an easement to the STATE for transportation purposes across that parcel. Easement No. 0038702 is attached hereto as Exhibit C, and made a part of this agreement. SECTION III. All parties agree as follows: I. That this Agreement shall become effective on the first date mentioned above, and shall remain in full force and effect until amended or replaced upon the mutual consent of the STATE and the CITY. EXECUTION This Agreement is executed for the STATE by its Assistant Chief Engineer; and executed for the CITY by the Mayor, attested to by the City Clerk, with the imprinted corporate seal of the CITY OF MOSCOW.
