RESOLUTION NO. 2009- 06 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING THE EXISTING CITY POLICY TO ADOPT DEPARTMENT OF LABOR FINAL REGULATIONS INTERPRETING THE FAMILY AND MEDICAL LEAVE ACT; PROVIDING THIS RESOLUTION TO BE EFFECTIVE UPON ITS PASSAGE AND APPROVAL. WHEREAS, the City of Moscow desires to follow all federal and state regulations which directly bear upon the employment of City employees; and WHEREAS, the U.S. Department of Labor (DOL) has issued new final regulations interpreting the Family and Medical Leave Act (FMLA); and WHEREAS, the FMLA amendments provide significant new rights to eligible employees with military family members; and WHEREAS, these changes allow employees to take time off to care for a seriously ill service member and for qualifying exigencies related to a family member's call to duty; and WHEREAS, these new regulations took effect on January 16, 2009; and WHEREAS, the City personnel policies (including the City's Family and Medical Leave Act Policy and the Leaves of Absence policy) have been revised to reflect the new final federal regulations; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow as follows: 1. The City hereby adopts as a portion of the Personnel Policies applicable to all City employees the newly revised Family and Medical Leave portions of the Policies (pages 14 through 1 5A) and the newly revised Leaves of Absence portions of the Policies (pages 64, 65) as attached in Exhibit to this Resolution. 2. That this Resolution shall become effective as of the 161h day of March, 2009. PASSED AND APPROVED by the Mayor of the City of Moscow, Idaho, this l61h day of March, 2009. PAGE 1 or 1
