The permit requires the comprehensive management of urban stormwater discharged through municipal separate storm sewer systems (MS4s) into Hayden Lake, Fernan Lake, Coeur d’Alene Lake, and Spokane River, as required by federal Clean Water Act regulations. To recognize the three Highway Districts as co-permittees with comparable stormwater management responsibilities under a single NPDES permit, the EPA proposes to consolidate prior MS4 permits issued individually to Lakes Highway District and Post Falls Highway District, and for the first time include East Side Highway District. Therefore, as part of this action, the EPA also proposes to terminate the prior individual MS4 permit for Post Falls Highway District (permit number IDS028193), upon issuance of the final permit to all three highway districts. Tentative Determination The Region 10 office of the EPA has tentatively determined to issue a discharge permit to the applicants. State Water Quality Certification This notice will serve as public notice of the intent of the state of Idaho, Department of Environmental Quality, to consider certifying that the subject discharges will comply with the applicable provisions of the Sections 208(e), 301, 302, 303, 306 and 307 of the Clean Water Act. The NPDES permit will not be issued until the certification requirements of Section 401 have been met.
