LEASE AGREEMENT BETWEEN CITY OF MOSCOW, IDAHO AND CRAIG GREENWALT THIS LEASE AGREEMENT BETWEEN CITY OF MOSCOW IDAHO AND CRAIG GREENWALT (hereinafter Agreement) is entered into this 4- day of M , 2016 by and between the City of Moscow, Idaho, a municipal corporation of the State of Id· o, 206 East Third Street (hereinafter "City"), and Craig Greenwalt, 2116 East Vandal Drive, Moscow, Idaho, 83843 (hereinafter "Greenwalt"). The Parties agree as follows: PROPERTY. City, in consideration of lease payments provided in this Agreement, leases to Greenwalt, for the planting and harvesting of agricultural crops only, twenty (20) acres of City property located on West Palouse River Drive, Moscow, Idaho, adjacent to and west of Palouse Hills mobile home court located at 913 West Palouse River Drive; twenty (20) acres, also adjacent to and south of the Palouse River. LEASE PAYMENTS. Greenwalt agrees to pay City the sum of seventy dollars ($70) per acre for twenty (20) acres, per year, of City-owned property; said property to be used for the planting and harvesting of agricultural crops. Total annual payments of one thousand four hundred dollars ($1,400) to be paid prior to the 30th day of November of each year that said property is planted for agricultural crops. Any year said property is left fallow, no payments shall be required. TERM. The Agreement term will be from January 1, 2016 through December 31, 2016. This Agreement is automatically renewed for an additional one year term for a period of ten (10) years, unless notice to terminate has been given sooner by either Party. Should either Party wish to terminate this Agreement, said Party shall provide written notice to the other Party no later than the 1st day of December of the year prior to the date the Party wishes to terminate. INDEMNIFICATION. Greenwalt does hereby agree to defend and indemnify and does hereby release, hold harmless, acquit and forever discharge City and its successors, assigns, agents, servants, employees and insurers, and all persons acting for, by, or through, or in any way in behalf of City, of and from all legal and equitable claims, of every kind, actions, causes of action, judgments, damages, liabilities and demands of whatsoever kind, name, or nature, known or unknown, contingent or mature, in any way having to do with, arising, having arisen, to arise, or which may arise out of or by reason of Greenwalt' s use and lease term of City property, which results in or relates to, in any way, property damage or any death or injury suffered or incurred to anyone during the lease term of City property.
