RESOLUTION NO. 2006 - 1 0 A RESOLUTION ACCEPTING DEED OF DEDICATION OF PROPERTY FOR PUBLIC RIGHT OF WAY AS AN EAST SECTION OF NORTH ALMON STREET. WHEREAS, City of Moscow, Idaho has determined that it is in its best interest to accept the dedication of land described herein below as public right of way; and WHEREAS, acceptance of such right of way is in accordance with Idaho Code, Title 50, Chapter 13; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSCOW, IDAHO that the City shall accept dedication of the property described herein below as public right of way. RESOLVED THIS 3rd day of April, 2006. 1. Legal Description as follows: A portion of that parcel of land described in Quitclaim Deed No.501182 on file with the Recorder's office of said Latah County, situated in the NE1/4, of Section 7, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, with said portion being more particularly described as follows: Beginning at the northeast corner of said Section 7, thence S86°30'W, along the north line of said Section 7, 400.15 feet (deed 394.57 feet), to a point on the former westerly right-of-way line of the Burlington Northern Railroad; thence S10°06'W, 1335.92 feet (deed 1334.41 feet), along said westerly right-of-way line to a point of curvature (railroad station 4578+94.9); thence southerly 341.24 feet, along a curve to the left, said curve having a radius of 2342.01 feet, a central angle of 08°20'54", and a chord bearing S05°55'33"W, 340.94 feet, to the northwest corner of the Robinson tract as described in Instrument No.367643 as recorded at the Latah County Courthouse, Moscow, Idaho, and being the TRUE POINT OF BEGINNING; thence S88°14'54"E, 10.63 feet, along the north boundary of said Robinson Tract; thence southerly 248.44 feet, along a curve to the left, said curve having a radius of 1611.02 feet, a central angle of 08°50'09", and a chord bearing S01 °56'17"E, 248.19 feet; thence S06°21 '22"E, 45.76 feet; thence 68.21 feet, along a curve to the right, said curve having a radius of 2147.11 feet, a central angle of 01 o 49' 12", and a chord bearing S05°26' 46"E, 68.20 feet, to the south boundary of said Robinson tract; thence S86°49'05"W, 24.60 feet, along said south boundary, to the southwest corner of said Robinson tract; Thence N01 °34'00"W, 227.55 feet, along the westerly boundary of said Robinson tract; thence continuing along said boundary, northerly 135.67 feet, along a curve to the right, said curve having a radius of 2342.01 feet, a central angle of 03°19'09", and a chord bearing N00°05'35"E, 135.65 feet, to the TRUE POINT OF BEGINNING.
