RESOLUTION NO. 91-05 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT IT IS THE POLICY OF THE CITY TO CREATE AND MAINTAIN A DRUG AND ALCOHOL FREE ENVIRONMENT IN THE WORK PLACE; PROVIDING THAT THIS RESOLUTION SHALL BE INCORPORATED IN THE CITY'S PERSONNEL RULES AND POLICIES; PROVIDING FOR THIS RESOLUTION TO BE IN FULL FORCE AND EFFECT UPON ITS PASSAGE AND APPROVAL. Whereas, this policy will be known as the DRUG AND ALCOHOL FREE WORK PLACE POLICY; NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MOSCOW AS FOLLOWS: I. STATEMENT OF PURPOSE: The purpose of this resolution is to maintain a safe and healthful work environment for employees and provide for the continuation of a high level of service to the public by: A. prohibiting the use of illegal controlled substances or alcohol within the workplace. B. increasing employee awareness of the dangers of controlled substances and alcohol abuse. C. providing appropriate support and assistance to employees who have controlled substance or alcohol abuse problems. 2. DEFL)ITIONS: The following definitions shall be incorporated into this policy: A. CONTROLLED SUBSTANCE shall include any controlled substance as defined in Title 37, Chapter 27, of Idaho Code or in Schedules I through 5 of Section 202 of the Federal Controlled Substance Act. Examples of controlled substances include marijuana, cocaine, heroin and morphine as well as barbiturates and amphetamines. B. ALCOHOL means any alcoholic beverage, including beer and wine. C. ON THE JOB refers to any time the person is being paid for services by, or acting as an employee or agent of the City. 3. PROHIBITED ACTS: The following acts by any employee of the City, are hereby prohibited: A. Consumption of alcohol or use of a controlled substance (without a prescription) while on the job or in a city-owned vehicle. B. The manufacture, growing of, sale or other use of any controlled substance in violation of state or federal law. ---PAGE BREAK--- 4. POLICY ACKl JWLEDGEMENT AND EDUCATit-A: A copy of the City's substance abuse policy shall be given to each employee. In order to educate employees about the dangers of controlled substances and alcohol abuse, the City shall establish a controlled substance and alcohol abuse awareness program. Periodically employees will be required to attend informational sessions during which the dangers of controlled substance and alcohol abuse, the City's Drug and Alcohol Free Work Place Policy, the availability of counseling, and the City's employee assistance plan will be discussed. 5. CONVICTIONS; DISCIPLINARY ACTION: Employees who are convicted of offenses involving controlled substances or alcohol in the work place (including employees who plead no contest) must inform the department head of such conviction within five days of the conviction or plea period. Employees who violate any aspect of this policy are subject to disciplinary action, up to and including termination. They may be required, at the City's discretion, to participate in and successfully complete a controlled substance or alcohol abuse rehabilitation program as a condition of continued employment. 6. INCORPORATION INTO PERSONNEL POLICY: This Resolution shall be incorporated into the City's personnel rules and policies. 7. EFFECTIVE DATE: This policy shall be effective upon its passage and approval by the City Council. RESOLVED by the City Council and APPROVED by the Mayor this 19th day of February, 1991. ATTEST:
