GIS DATA SHARING .MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN LATAH COUNTY, IDAHO Al'ID CITY OF MOSCOW, IDAHO WHEREAS, City of Moscow, Idaho (hereinafter "CITY") is a municipal corporation of the State of Idaho; and WHEREAS, Latah County, Idaho (hereinafter "COUNTY") is a county and political subdivision of the State of Idaho; and WHEREAS, CITY and COUNTY currently each possess Geographic Information System (GIS) data used and created in the normal conduct of their respective governmental activities; and WHEREAS, CITY and COUNTY wish to exchange GIS data with one another to promote efficiency in each other's governmental operations and in the collection and creation of GIS data; and WHEREAS, CITY and COUNTY also desire to improve the public benefit of data and information obtained and created with public funds by sharing GIS data as described within this MOU. SECTION 1: COOPERATION. CITY and COUNTY are jointly committed to facilitate the transfer and/or sharing of GIS data to facilitate the efficient governmental operations and service to the jointly served constituents of both Parties. This MOU is intended to clarify the expectations and responsibilities of both CITY and COUNTY. Nothing within this MOU shall prohibit CITY and COUNTY from sharing additional GIS data that is not specified within this MOU where it is deemed appropriate. SECTION 2: CITY'S OBLIGATION. During the term of this MOU: CITY shall provide COUNTY with its revised and enhanced City parcel map in a digital format (hereinafter "Revised City Parcel Map"), created through CITY's contracted professional services with Geographic Mapping Consultants (GMCI), and CITY shall provide COUNTY with digital AutoCAD forn1at, compatible with AutoCAD version 2000 (15), copies of all subdivision plats approved by CITY within fourteen (14) days of signature upon such plat by the City Engineer. CITY shall also provide the services of GMCI to fit the Revised City Parcel Map within COUNTY's existing parcel map. CITY shall also provide technical support necessary to establish and to support continued data sharing such as network connectivity through a virtual private network connection to exchange the subject GIS data in a shared storage location (hereinafter "Shared Storage Location"). During the term of this MOU: COUNTY shall establish a Shared Storage Location connection with the City. Within fourteen (21) days of receipt of the Revised City Parcel Map, COUNTY shall place and thereafter maintain a single ArcGIS shapefile parcel data layer (hereinafter "COUNTY Parcel Map") with the following associated parcel attribute fields (hereinafter "Parcel Attributes") from the Idaho State Tax Commission database; Parcel Address, Parcel Owner, Parcel Owner Mailing Address, Parcel Category, Parcel Valuation, and Parcel Legal Description. Additional parcel attributes can be added with the mutual consent of City and County. COUNTY shall maintain and update the COUNTY Parcel Map and associated Parcel Attributes in digital format, and copies of subject digital data shall be placed upon Shared Storage Location via scheduled automation daily, to ensure that it is the most current and accurate information available to CITY. It must be noted that there is a period of time between October 1 and May 1 of the following year that a mapped parcel may not have the associated Parcel Attributes. Within fourteen ( 14) days of recordation with the COUNTY of a final plat which is located within the City of Moscow and which has been previously provided digitally by CITY to COUNTY (as described within Section 2 of this MOU), COUNTY shall incorporate such plat and the associated new parcels within the COUNTY Parcel Map and Parcel Attributes located upon the Shared Network Location. SECTION 4: RESTRICTION ON USE OF DATA/ RIGHT OF USE Both CITY and COUNTY agree that the data exchanged pursuant to this MOU shall be used by CITY and COUNTY for their respective general governmental use. The County Parcel Map shall be part of the Latah County's computerized mapping system under Idaho Code 31-875. CITY agrees that the County Parcel Map and Property Table data shall not be sold or transferred to a third party without the prior written consent of COUNTY. Any transfer of data shall comply with LATAH COUNTY, IDAHO ORDINANCE NO 251, GIS ORDINANCE. For the purposes of this MOU the official "Custodian" of all GIS data exchanged between CITY and COUNTY shall be the entity from which the subject data originates, and any request for such digital data shall be made to that entity. SECTION 5: EMPLOYMENT PRACTICES I NON-DISCRIMINATION. CITY and COUNTY agree to comply with all Federal, State and local laws, rules and regulations relation to non-discrimination in its employment and hiring practices. The term of this MOU shall be for a period of f1ve years unless otherwise agreed to by the parties in writing. SECTION 7: NON-APPROPRIATION. This MOU is contingent upon CITY and COUNTY appropriating the necessary funding to cover the obligations of CITY and COUNTY in regard to this MOU. In the event that such funding is not received or appropriated, then, and in that event, CITY's and/or COUNTY's obligations under this MOU shall cease and each party shall be released from further performance under this MOU without any liability to the other party. SECTION 8: TERMINATION This MOU may be terminated at any time, for cause, by CITY and COUNTY. Such request for termination of this MOU shall be made in writing to the other party. Upon receipt of written notice of termination by the other party, CITY and COUNTY's obligations under this MOU shall cease and each party shall be released from further performance under this MOU.
