PERMANENT SANITARY SEWER EASEMENT jE TED V. BURRAGE and CAROLYN BURRAGE, whose curr<:nt address is 2530 Blaine Road, Moscow, Idaho, 83843, GRANTORS, owner of real property affected hereby, for value received, do hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTEE, and its agents and assigns, a non-exclusive permanent easement and right-of-way in which to construct and maintain a public sanitary sewer main, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: A 15 foot wide easement located in the northeast quarter of Section 19, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, and situated within the Burrage tract described in the Quit Claim Deed recorded as Instrument No. 429908, records of Latah County, Idaho, with said easement shown on the attached EXHIBIT and being more particularly described as follows: Commencing at the southeast corner of Plot 2 of the Allen Tracts Subdivision recorded in Book 4 of Plats, page 20, records of Latah County, Idaho; thence S02.03"E 324.80 feet to the northwest corner of said Burrage tract; thence N86.46'E 82.61 feet along the north boundary of said tract to the northwest corner of an existing sanitary sewer easement recorded as Instrument No. 363180, records of Latah County, Idaho; thence S01.45'19"E 128.97 feet to the southwest corner of said existing easement and the TRUE POINT OF BEGINNING; thence continuing S01.45'19"E 0.94 feet; thence S08.54'06"E 93.58 feet to the southerly boundary of said Burrage tract; thence N86° 46'E 15.07 feet, along said boundary; thence N08.54'06"W 94.13 feet to the southeast corner of said existing easement; thence S88.14'41'W 15.00 feet along said existiny easement, to the TRUE POINT OF BEGINNING. Said easement contains 1,415 square feet, more or less. For the purpose of constructing, operating, maintaining, and repairing or replacing said public sanitary sewer main by the City of Moscow or its agents or contractors or franchised utility companies. GRANTORS, their successors and assigns, reserve the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the public sanitary sewer main. GRANTORS agree that they and their heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. The GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid public sanitary sewer main (including, but not limited thereto, the right to make necessary repairs, altemtions, and removals or replacement thereof). Upon exercising these rights, GRANTEE shall restore the property to its prior condition and shall compensate GRANTORS, their successors or assignees, for any damages suffered. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes.
