THIRD AMENDMENT TO AGREEMENT BETWEEN CITY OF MOSCOW, IDAHO AND SOUTHEAST MOSCOW WATER AND SEWER DISTRICT THIS THIRD AMENDMENT TO THE AGREEMENT MADE BETWEEN CITY OF MOSCOW, IDAHO (hereinafter "CITY") AND SOUTHEAST MOSCOW WATER AND SEWER DISTRICT (hereinafter "DISTRICT") is for the purpose of extending the current Agreement between the Parties to a term ending the 1st day of July, 2014. WHEREAS, CITY wishes to continue to provide to DISTRICT the services contained within the Agreement between CITY and DISTRICT entered into the 3rd day of June, 1991 and subsequently amended and then extended, and which the Parties are currently operating under; and WHEREAS, DISTRICT wishes that the services provided by CITY continue under the same terms and conditions as the Agreement between the parties dated the 3rd day of June, 1991; and WHEREAS, the Agreement termination date was modified by an Amendment to the Agreement in November 2012 to a new date of September 30, 2013 and subsequently extended to the 31st day of December, 2013; NOW, THEREFORE, in consideration of the covenants and agreements set forth in the Agreement between the parties entered into the 3rd day of June, 1991, it is mutually agreed as follows: Agreement To Extend Agreement Termination Date. Pursuant to Section III, paragraph 7 of the Agreement between the parties dated the 3rd day of June, 1991, the parties hereby agree that the term of such Agreement has not terminated but shall continue until the 1st day of July, 2014 under the same terms, conditions, covenants, and agreements as the original Agreement entered into by the parties on the 3rd day of June, 1991.
