RESOLUTION NO. 90-06 WHEREAS, it is the responsibility of government to protect the public welfare; and WHEREAS, it is the duty of government to protect the public trust which includes future generations; and WHEREAS, the Federal Government's Department of Energy owns and operates vast nuclear reservations which include the Hanford Reservation and the Idaho National Engineering Laboratory; and WHEREAS, Moscow City is downwind of the Hanford Reservation; and WHEREAS, Moscow City is of the Idaho National Engineering Laboratory; and WHEREAS, the Department of Energy has sovereign immunity from compliance with State and Federal environmental laws under the Atomic Energy Act of 1946 and the Resource Conservation Recovery Act; and WHEREAS, White House 1988 Executive Order #12580 f urther forbids other Federal agencies from exerc1s1ng enforcement actions on the Department of Energy; and WHEREAS, Department of Energy's manufacturing and processing operations produce radioactive waste substances; and WHEREAS, Department of Energy operations have contaminated the soil and ground water in violation of State and Federal environmental laws; and WHEREAS, individuals living near Department of Energy's Hanford Nuclear Reservation and Idaho National Engineering Laboratory have been put at risk; and WHEREAS, individuals inj ured by Department of Energy operations are barred from compensation claims under U.S. Tort law by sovereign immunity granted under the Atomic Energy Act of 1946. NOW THEREFORE BE IT RESOLVED THAT the Moscow City Council is in favor of eliminating the U.S. Department of Energy's sovereign immunity to comply with State and Federal environmental laws and individual access under U.S. Tort law for damage claims resulting from Department of Energy operations. ---PAGE BREAK--- Dated this 6th day of August, 1990.
