RESOLUTION NO. 2010-20 A RESOLUTION OF THE CITY OF MOSCOW, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, CREATING A POLICY REGARDING THE USE OF SECURITY CAMERAS WITHIN THE CITY; PROVIDING THIS RESOLUTION TO BE EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, one of the purposes of security cameras is to assist in protecting the safety and property of the community (including City facilities); and WHEREAS, the Council wishes to regulate the use of security cameras in order to protect the legal and privacy interests of the community; and WHEREAS, no security camera will be placed on City property without specific authorization by Council for each camera location; and WHEREAS, only authorized personnel, as designated by this Policy, will be involved in, or have access to, security camera data; and WHEREAS, the primary use of security cameras placed by the City will be to record images for future identification of individuals in the event of crimes, dan1age to City property, or reports of suspicious behavior on or near City facilities; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow that the Policy regarding use of security cameras by the City shall be as follows: Policy Regarding Use of Security Cameras 1. The purpose of this Policy is to regulate the use of security cameras to protect the legal and privacy interests of the City and the community; to assist in protecting City safety and property; and to record images for future identification of individuals in the event of crimes, damage to property or City facilities, or reports of suspected criminal behavior. 2. The Moscow Chief of Police or designee will function as the security camera coordinator for the City and will manage security cameras in consultation with the City Supervisor, City Attomey, City Parks and Recreation Director, and Information Systems Director, and pursuant to this Policy. The Police Chief shall ensure that any access to security camera data will not be disseminated more widely than reasonably necessary to accomplish the purposes of this Policy. 3. Only authorized personnel, as determined by this Policy and authorized by the Council, will be involved in, or have access to, security camera data. Authorized personnel includes the Police Chief, Fire Chief, Parks and Recreation Director, Infom1ation Systems Director, City Attomey, City Prosecutor, City Supervisor, or their designee. Such authorized personnel may have access to security camera data in RESOLUTION 20 I 0- 20 SECURITY CAMERA OCTOBER 18, 20 I 0 PAGE I OF2 ---PAGE BREAK--- their areas of responsibility and only as authorized by the Police Chief on a case-by­ case basis; however, the Moscow Police Department will have access to all security camera data. 4. Security cameras may be installed in situations and places where the security of a City facility, City property, or people would be enhanced, in conformance with this Policy and as approved by City Council. 5. Cameras will be used in a professional, ethical, and legal manner. 6. Camera use will be limited to situations that do not violate the reasonable expectation of privacy, as defined by law. 7. Staff will recommend to Council the placement of security cameras. Council shall retain final authority to approve placement of each can1era. Once approved by Council, security cameras will be maintained by the City. 8. Security cameras shall not record or monitor sound. 9. Recorded security camera data must be retained pursuant to Idaho Code and City policy. 10. Requests to release information obtained through security cameras to others than authorized personnel must be submitted to the City Clerk and approved as required by the Idaho Public Record Law prior to release, if any. 1 1. In addition to restrictions contained in this Policy, security camera data may be subject to confidentiality restrictions (including, but not limited to, the Idaho Public Record Law). 12. Cameras installed or utilized for criminal investigations are subject to appropriate Idaho and Federal laws and are excluded from this Policy. 13. This Resolution shall become effective as of 18th day of October, 2010. PASSED AND APPROVED by the Mayor of the City of Moscow, Idaho, this 18th day of October, 2010.
