RESOLUTION 2017 - 05 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STA TE OF IDAHO, AUTHORIZING THE DESIGNATION OF A TEN (10) ACRE PROPERTY LEGALLY DESCRIBED HEREIN AND AS SHOWN ON EXHIBIT ATTACHED HERETO, AND IN CORPORA TED HEREIN BY THIS REFERENCE, AS AUTO-URBAN COMMERCIAL (AU-C); PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PAS SAGE AND APPROVAL. WHEREAS, the owner of the subject property has requested annexation of the subject land within the City of Moscow; and WHEREAS, in accordance with Idaho Code, the City must determine the appropriate Comprehensive Plan Land Use Designation for the subject property upon annexation; and WHEREAS, the subject property is currently located within the City of Moscow Area of City Impact and is designated as Auto-Urban Commercial (AU-C) upon the City of Moscow Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission, after conducting a duly noticed public hearing on February 8, 2017, recommended that the Comprehensive Plan Land Use Designation of the subject property remain Auto-Urban Commercial (AU-C) upon annexation into the City of Moscow; and WHEREAS, the Moscow City Council conducted a public hearing on March 6, 2017 and passed a motion to approve the continued designation of the subject property as Auto-Urban Commercial (AU-C) upon Annexation. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Moscow, Idaho as follows: That the Comprehensive Plan Land Use Designation of the ten (10) acres legally described below, remain designated as Auto-Urban Commercial (AU-C) upon annexation into the City of Moscow, Idaho. LEGAL DESCRIPTION: A parcel of land located in the northwest quarter of Section 12, Township 39 North, Range 6 West of the Boise Meridian, Latah County, Idaho, described as follows: BEGINNING at the west quarter comer of Section 12; Thence along the south line of the northwest quarter of Section 12, S 89°02'03" E, 878.43 feet; Thence leaving said south line, N 30°49'55" E, 500.70 feet; Thence N 89°01 '11" W, 1127.75 feet to the west line of Section 12; Thence along said west line, S 00°58'04" W, 434.48 feet to the POINT OF BEGINNING.
