QUITCLAIM DEED PRESERVING PERMANENT ACCESS AND UNDERGROUND UTILITY EASEMENTS KNOW ALL PERSONS BY THESE PRESENTS: 541821 This Quitclaim Deed Preserving Permanent Access and Underground Utility Easements, made this day of Vat:rn fiu.-, 2010, between the City of Moscow, Idaho, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho, 83843 (hereinafter "GRANTOR"), and Robert C. Peterson, 2733 Sunset Drive, Lewiston, Idaho, 83501 (hereinafter "GRANTEE"): Wherefore GRANTOR, in and for valuable consideration does hereby remise, release, and quitclaim to GRANTEE all of GRANTOR'S right, title and interest in and to the following­ described real estate located in the City of Moscow, County ofLatah, State ofldaho, to wit: A tract of land located in the Northeast Quarter of the Southeast Quarter of the Northwest Quarter of Section 7, T. 39 R. 5 B.M. in the City of Moscow, Latah County Idaho, more particularly described as follows. Commencing at the Northeast Corner of the Southeast Quarter of the Northwest Quarter of said Section 7, running thence S 87°26' 10" W 30.06 feet along the North 1116th line of said Section 7 to the Northeast Corner of the City of Moscow Tract recorded as Inst. No. 21603 1 with the Recorder's office of said county, and the TRUE POINT OF BEGINNING of this description; thence S 00°55'58" W 213.50 feet along the East line of said Inst. No. 216031; thence N 26°18'02" W 87.23 feet along the Southwesterly line of said Inst. No. 216031; thence S 87°26' 1 0" W 79.68 feet along the South line of said lnst. No. 216031; thence N 00°56'02" E 133.50 feet to a point on the North 1116th line of said Section 7; thence N 87°26'10" E 119.67 feet along said 1116th line to the TRUE POINT OF BEGINNING. Said tract contains 17,543 square feet or 0.40 acres more or less to have and to hold the said premises, with their appurtenances unto said GRANTEE, its heirs and assigns forever Subject, however, to GRANTOR's reservation of a permanent access and underground utility easement for ingress and egress, and for the repair, maintenance and/or replacement of existing underground water mains, storm drainage systems, sewerage systems, and other existing public utilities such as electric, gas, telecommunications, and cable television, in, over and upon the above described real estate for so long as GRANTOR shall utilize portions of such premises for said stated public utilities purposes.
