RESOLUTION NO. 98-12 WHEREAS, the owner of the land described in Attachment of this Resolution has requested a change of the Comprehensive Plan Land Use Designation of said land from High Density Residential (HR) to Extensive Commercial (EC); and WHEREAS, the most recent edition of the Moscow Comprehensive Plan was adopted by the Moscow City Council and signed by the Mayor by Resolution No. 97-07 on August 25, 1997; and WHEREAS the Planning and Zoning Commission considered this matter by duly noticed public hearing held on August 26, 1998, after which the Commission voted to recommend approval of the requested Land Use Designation Change; and WHEREAS, the Mayor and City Council considered this matter by duly noticed public hearing held on September 21, 1998; and WHEREAS, the land described in Attachment is adjacent to lands designated Extensive Commercial (EC) on the Comprehensive Plan Map; and WHEREAS, said land is bordered extensively by railroad right of way; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL, sitting as the governing board for Moscow, Idaho and adopting the change as recommended by the Moscow Planning and Zoning Commission, that the land described in Attachment" A" to this Resolution be hereby redesignated from High Density Residential (HR) to Extensive Commercial (EC) on the Moscow Comprehensive Plan Map and that the City Engineer be hereby directed to have said change made on said Comprehensive Plan Map. Resolution 98-12 Sept(•tnber 21, 1998 PAGE 1 OF 2 ---PAGE BREAK--- ATTACHMENT Beginning at the point of intersection of the South property line of Third Street in the City of Moscow, Idaho, with the Northeasterly right of way line of the Northern Pacific Railway Company's Right of Way across said subdivision; thence Southeasterly along said named right of way line to a point 150 feet from the Westerly line of Lilly Street, produced Southerly measured along said right of way line; thence Northerly on a line parallel with said Westerly line of Lilly Street, produced, to the point of intersection with the Southwesterly right of way line of the Oregon-Washington Railroad Navigation Company's Right of Way; thence Northwesterly along said last named right of way line to the point of intersection with the above named South property line of Third Street; thence West along said South property line of Third Street to the point of beginning; it being the intention to convey all of that certain strip of land lying and being between the right of way line of the Oregon-Washington Railroad Navigation Company's Right of Way; thence Northwesterly along said last named right of way line to the point of intersection with the above named South property line of Third Street; thence West along said South property line of Third Street to the pomt of beginning; it being the intention to convey all of that certain strip of land lying and being between the Northeasterly right of way line of the Northern Pacific Railway Company's Right of Way and the Southwesterly Right of Way line of the Oregon-Washington Railroad and Navigation Company's Right of Way, and extending from the South property line of Third Street in the City of Moscow, Idaho, to the Westerly line of Lilly Street, produced Southerly, save and except a certain strip of land 150 feet in length abutting on said Westerly line of Lilly Street, produced, deeded to the Northern Pacific Railway Company by Joseph R Collins and Avis E.
