516607 PERMANENT SANITARY SEWER EASEMENT MOSCOW RENTALS, LLC., an Idaho limited liability company, GRANTOR, whose current address is 1310 Youmans Lane, Moscow, Idaho 83843, owner of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTEE, and its agents and assigns, a non-exclusive permanent access easement for the purpose of maintaining a public sanitary sewer located adjacent to GRANTOR'S property, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: An access easement located in that parcel described in Quit Claim Deed No.454569 on file with the Recorder's office of said Latah County, and situated in Lot 2 of Russell's Addition to the City of Moscow, Latah County, Idaho, recorded in Book 1 of Plats, page 3, said easement shown on the attached EXHIBIT and being more particularly described as follows: AN EASEMENT consisting of the north 19.0 feet and the east 40.0 feet of the following described parcel: Beginning at a point on the east right-of-way line of Jefferson Street, said point being S89°58'E 748.65 feet and North 563.50 feet from the southwest corner of Section 8, Township 39 North, Range 5 West, Boise Meridian; thence S89.58'E 125.00 feet; thence North 64.00 feet; thence N89.58'W 125.00 feet to a point on said east right-of-way line; thence South along said right-of-way line 64.00 feet to the point of beginning. ALSO INCLUDING an easement consisting of the east 40.0 feet of the following described parcel: Beginning at a point on the east right-of-way line of Jefferson Street, said point being 188 feet north of the southwest corner of said Lot 2 of Russell's Addition; thence East at right angles to said right-of-way line 125 feet; thence North at right angles 40 feet; thence West at right angles 125 feet to said right-of-way line; thence South along said line 40 feet to the point of beginning. for the purpose of constructing, operating, maintaining, and repairing or replacing a public sanitary sewer by the City of Moscow or its agents or contractors, said sewer being located immediately to the east of and parallel with the east property line of said described parcels. GRANTOR, its successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably interfere with GRANTEE'S access rights. GRANTOR agrees that it and its heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. PERMANENT SANITARY SEWER EASEMENT Page 1 of2 2007-30 ---PAGE BREAK--- The GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid sanitary sewer (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof). Upon exercising these rights, GRANTEE shall restore GRANTOR'S property to its prior condition. GRANTEE is granted the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes. It is expressly intended that the rights, burdens and restrictions contained in this Easement shall run with the land and shall forever bind GRANTOR AND GRANTEE, their heirs and assigns.
