ADDENDUM TO AGREEMENT THI c:r%Jl.DENDUM to the 'Agreement for Waiver of Compensation' (dated March 30, l&by and between the City of Moscow (CITY), a municipal corporation of the State of Idaho and Indian Hills Trading Company (IHTC), an Idaho corporation, is entered into this 'ay of:::f'l.Vv'-Q... , 1994. WITNESSETH: WHEREAS, the paties acknowledge that circumstances related to the Street construction project have changed in several minor regards; and WHEREAS, the Agreement of Waiver of Compensation provided that: 1. IHTC'ʭ pitrticipntion in n Loonl Improvement District would be limited to the City Engineer's estimate of construction costs (estimated at that time to be approximately $260,000) with adjustments not to exceed twenty percent (20%) of that estimate (for a maximum of approximately $310,000); and 2. That properties not owned by IHTC would receive no assessment under a proposed T JJ); and WHEREAS, the pw:ties des1re to see this project move forward, to their mutual benefit; NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES CONTAINED HEREIN, THE PARTIES HEREBY AGREE TO AMEND THEIR EARLIER AGREEMENT AS FOLLOWS: 1. That prope1ties owned by Mosoʰ;w Supʫr 8 Development Prutnership and by Wenzel and Juhuue be included in the LID and assessed by the CITY to the extent that the law pennits. 2. That 1HTC'ʬ total LID assessments will not exceed $316,000. 3. That IHTC will not object to fonnation of the LID No. 117 or to assessments of IHTC'l:l property, so long us such assessments arc consistent with this agreement and oll prior ogreemetlls rch:vant hereto. 5. Tlutt IHTC will contribute $9,500 for additional improvements on Street outside the boundaries of this project superseeding that certain Developrnent Agreement between IHTC and the City of Moscow dated April 6, 1992 only to the extent that section VTI B of such Agn:ʮ::menl shall reflect such AMENDMENT TO CONTRACT - 1 94-45 ---PAGE BREAK--- $9,500 and the remaining tem1s of such Development Agreement shall continue to be in full force and effect. 6. That no other charges, payments or assessments shall be made by the CITY against THTC pertaining to construction of street or street except as may be approved by IHTC: in writing. 7. That all remaining provisions of the Agreement for Waiver of Compensation dated March 30, 1993 shall remain in filii force and effect. 8. That this agreement shall expire on March 30, 1996.
