KNOW ALL MEN BY THESE PRESENTS, that MOSCOW SCHOOL DISTRICT NO. 281 (GRANTOR), owner of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, (GRANTEE), and its agents and assigns, a permanent easement and right-of-way in which to construct and maintain a public bus stop shelter, including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: A public easement consisting of a portion of the Moscow School District No. 281 tract described in the Warranty Deed recorded in Book 137 of Deeds, page 134, records of said Latah County, located in the southeast quarter of the northeast quarter of Section 8, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, said portion shown on the attached Exhibit and being more particularly described as follows: Commencing at a point 1005.00 feet north and 30.01 feet N88°30'W of the southeast corner of the northeast quarter of said Section 8, said point being the intersection of the west right-of-way line of Mountainview Road and the south right-of-way line of Street; thence N88°30'W 5. 73 feet along said south right-of-way line to the TRUE POINT OF BEGINNING; thence continuing along said right-of-way line, N88°30'W 26.04 feet; thence leaving said right-of-way line, S24°59'00"E 10.11 feet along the northeasterly edge of an existing concrete sidewalk; thence N68°42'59"E 23.36 feet along the northwesterly edge of an existing concrete sidewalk to the TRUE POINT OF BEGINNING and the end of this description. Said easement contains 118 square feet, more or less. For the purpose of constructing, operating, maintaining, and replacing a public bus stop shelter by the City of Moscow or its agents or contractors. GRANTOR, its successors and assigns, reserves the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the shelter. GRANTOR agrees that it and its agents or transferees will not build or place any new encroachment thereon which will unreasonably interfere with the right of GRANTEE. GRANTEE, its agents or transferees, shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid shelter (including, but not limited thereto, the right to make necessary repairs, alterations, and removals or replacement thereof. GRANTEE is granted Page 1 ---PAGE BREAK--- the aforementioned rights, together with the rights and privileges of ingress and egress to and from said property for the above stated purposes. It is expressly intended that these burdens and restrictions shall run with the land and shall bind GRANTOR, its agents or transferees until said bus stop shelter site is no longer required by GRANTEE, at which point said shelter will be removed by GRANTEE and said easement area shall be returned to it's prior condition.
