ORDINANCE NO. 1460 315666 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF IDAHO, ANNEXING CERTAIN LANDS ADJACENT TO THE CITY OF ë10SCOH viHICH ARE LOCATED IN SECTION 12, T 39 N, R 6 H, B.M. AND MORE PARTICULARLY DESCRIBED IN SECTION 2 OF THIS ORDINANCE; PROVIDING THAT THE CLERK SHALL CERTIFY COPIES OF SAID ORDINANCE HITH THE COUNTY AUDITOR, TREASURER AND ASSESSOR AND HITH THE IDAHO STATE TAX COMMISSION; PROVIDING THAT THE CITY MAPS OF THE CITY OF ì10SCO\í BE AMENDED ACCORDINGLY AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO: WHEREAS, the land described in Section 2 of this Ordinance is land lying adjacent to the City of Moscow, Idaho; and whereas said land is in tended and can reasonably be assumed to be used for the orderly development of the City of Moscow, Idaho; and whereas the owners of said land have re quested in writing of the Council of the City of Moscow, Idaho, that said land be annexed to the City of Moscow, Idaho. SECTION l. ANNEXATION. That the land described in Section 2 of this Ordinance be and the same hereby is annexed to the City of Moscow, Idaho, and that said land be and the same hereby is declared a part of the City of Moscow, Idaho. SECTION 2. DESCRIPTION: That the land annexed to and declared to be a part of the City of Moscow, Idaho, by this Ordinance is situated in Latah County, State of Idaho, and is more particularly described as to- wit: Parcel 1: U-Haul Property - A tract of land located in the East 1/2 of the Southwest Quarter of Section 12, T 39 N, R 6 W, B.M. more particularly described as0follows: 0 Beginning at a point S 00 201 W 374.64 feet and S 89 511 2411 51.38 feet of the Northwest corner of the Palouse Empire Mall Tract, said point being the TRUE POINT OF BEGINNING of ths des cription; thence, from this T§UE POINT OF BEGINNING, S 89 511 2411 W 306.00 feet; thence S 0 081 3611 E 430.73 feet to a point on t8e Northerly right-of-way line of State Highway No. 8; thence N 83 431 1611 E 150.00 feet, along said right-of-way linn, to a point of curvature of a non-tangent curve; thence N 84 301 1411 E 157.54 feet, along the long chord of said curvn, to a point of tangency (the center of the above curve bears S 6 1§1 4411 E having a radius of 5770.0 feet and a central angle of 1 331 5211 a9d a length, bearing Northeasterly, of 157.55 feet): thence N 0 081 3611 W 400.00 feet to the TRUE POINT OF BEGINNING. This tract contains 2.912 acres. Parcel 2: Parcel between U-Haul & Palouse Empire Mall property and North of North right-of-way line of Idaho State Highway No. 8 - A tract of land located in the West l/2 of the Southeast Quarter of Section 12, T 39 N, R 6 W, B.M. mobe particulary described as follows: Beginning at a point s 0 201 W 374.64 feet of th8 Northwest corner of the Palouse Empire îïall Tract; thence S 89 511 2411 W 51.38 feet to the Northeast corner of the U-Haul Com pany tract, said point being on the West line of a strip of land 20.0 feet in width as described in Instrument No. 13951, records of Latah County, ---PAGE BREAK--- 315666 Idaho, said point also being on Longitudinal Centerline of said Section 12; thence S oo 08' 3611 E 400.0 feet, along said centerline and/or said East line of the U-Haul Tract, to an intersection with the Northerly right-of-way line of Idaho State Highway No. 8, said point being a point of curvature of a non tangent curve; thence N 85° 31' 2311 E 48.22 feet, along the long chord of said curve, to a point of tangency (the center of the above curve bears S 4° 42' 5211 E having a radius of 5770.0 feet and a central angle of oo 28' 4411 and a length bearing North easterly of 48.22 feet), said point of tangency being a point of intersection of the West line of the Palouse Empire Mall Tract extended S ooo 20' W and the Northerly right-of-way line of Idaho State Highway No. 8; thence N oo 20' E 396.37 feet, along said West line of the Palouse Empire Mall tract to the point of beginning. This tract contains 0.454 acres. Parcel 4: Railroad right-of-way land South of the U-Haul Tract and adjacent to the Southerly right-of-way line of Idaho State Highway No. 8 - Beginning at a point on the Northerly right-of-way line_of _the Union Pacific Railroad Company, said point beingA's--sgo 51' 2411 W 357.38 feet and S 0° 08' 3611 E 560.86 feet of the Northwest corner of the Palouse Empire Mall Tract, said point being on an extension S oo 08' 3611 E of the West line of the U-Haul Tract and also being on the Southerly right-of-way line of Idaho State High way No. 8; thence S oo 08' 3611 E 182.16 feet to an intersection with the Southerly right-of-way line of the Burlington Northern Inc.; thence N 88° 30' 5411 E 3&-F.=-36 feet, -ólol'!.g_s_aid xi_ght-of- way line, to an intersection with the existing Moscow City Limits Line; thence N 0° 20' E 182.20 feet, along said City Limits line, to an intersection with the Northerly right-of-way line Union Pacific Railroad Company; thence S 88° 30' 5411 W 352.88 feet to the point of beginning. This tract contains 1.472 acres. ? v: ) SECTION 3: The City Engineer of the City of Moscow, Idaho be and is hereby ordered and directed to make the necessary amendments to the Official City Map, the Zoning Map and the Comprehensive Plan Map of the City of Moscow, Idaho, of which maps are on file at the City Hall of the City of Moscow, Idaho, to provide that said area is to be henceforth a part of the City of Moscow, Idaho. SECTION 4: PUBLICATION. That this Ordinance shall be published in one issue of the official newspaper of the City of Moscow, Idaho. ---PAGE BREAK--- SECTION 5: EFFECTIVE DATE. That this Ordinance shall be effective from and after the date of its passage and approval and the publication thereof in the aforesaid official newspaper of the City of Moscow, Idaho.
