PERMANENT PUBLIC UTILITY EASEMENT LLF, Inc. (an Idaho Corporation), GRANTORS, owners of real property affected hereby, in consideration of one dollar and other valuable consideration in hand paid, does hereby grant the CITY OF MOSCOW, a municipal corporation of the State of Idaho, 206 East Third Street, Moscow, Idaho 83843, GRANTEE, and its agents and assigns, two separate non-exclusive permanent easements and rights-of-way in which to construct and maintain public utilities including the right to enter upon, occupy and use property located in the City of Moscow, Latah County, Idaho, to wit: Easement No. 1: A permanent easement comprised of the west 10.00 feet of Lot 10, Block 4, Anderson 1st Addition to the City of Moscow, Latah County, Idaho, recorded as Instrument No. 404026 with the Recorder's office of said County. Easement No. 2: A permanent easement situated in Lots 8 and 9, Block 4, Anderson 1st Addition to the City of Moscow, Latah County, Idaho, recorded as Instrument No. 404026 with the Recorder's office of said County, and more particularly described as follows: Beginning at the southeast corner of said Lot 8; thence S88°57'02"W 21.54 feet along the south boundary of said Lot 8 to the southeast corner of said Lot 9; thence S88°57'02"W, 15.80 feet along the south boundary of said Lot 9; thence leaving said south line, N51°47'16"W 158.94 feet to a point on the north boundary of said Lot 9; thence easterly, along said boundary, 17.04 feet along a curve to the left, said curve having a radius of 45.00 feet, a central angle of 21°42'07", and a chord bearing N68°50'16"E 16.94 feet, to the northeast corner of said Lot 9 and the northwest corner of said Lot 8; thence continuing easterly, along the north boundary of said Lot 8, 5.65 feet along a curve to the left, said curve having a radius of 45.00 feet, a central angle of 07°11 '42", and a chord bearing N54°27'39"E 5.65 feet; thence leaving said west line, S51°47'16"E 141.59 feet; thence N88°57'02"E 29.15 feet to the east line of said Lot 8; thence S04°03'52"E 20.03 feet, along said east line to the southeast corner of said Lot 8 and the point of beginning. for the purpose of constructing, operating, maintaining, and repairing or replacing public utilities by the City of Moscow or its agents or contractors or franchised utility companies. GRANTORS, their successors and assigns, reserve the right to improve said easement area as long as such improvement shall not unreasonably interfere with the construction, operation, maintenance, repair and/or reconstruction of the utilities. GRANTORS agree that they and their heirs or assigns will not build or place any new encroachment thereon which will unreasonably interfere with the right of the GRANTEE. SANITARY SEWER EASEMENT Page 1 of 2 ---PAGE BREAK--- The GRANTEE, its agents or transferees. shall have the right to perform any maintenance it may deem necessary or wish to exercise in connection with the aforesaid utilities (including, but not limited thereto, the right to make necessary repairs, alterations. and removals or replacement thereof). Upon exercising these rights, GRANTEE shall restore the property to its prior condition and shall compensate GRANTORS, their successors or assignees, for any damages suffered. GRANTEE is granted the aforementioned rights. together with the rights and privileges of ingress and egress to and from said property for the above stated purposes. It is expressly intended that the rights. burdens and restrictions contained in this Easement shall run with the land and shall forever bind GRANTORS AND GRANTEE. their heirs and assigns.
