AT THE REQUEST Of' 01/J vo/ DATE & HOUR I  f / h L ORDINANCE NO. 2016-02 MEl-.JRIANNE l<.WESfW = ;;COUNTY AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL ;PORATIN OFT E ST A TE OF ' IDAHO, PROVIDING THAT LAND DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND GENERALLY SHOWN ON EXHIBIT ATTACHED HERETO AND IN CORPORA TED BY THIS REFERENCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, land described in Section 1 of this Ordinance is adjacent to City limits on two sides; and WHEREAS, the owner of the land described in Section 1 of this Ordinance has requested to be annexed into the City of Moscow; and WHEREAS, Idaho Code Section 50-222 authorizes City annexation of tracts of land adjacent to the City; and WHEREAS, the Moscow Planning and Zoning Commission held a public hearing regarding this matter on January 13, 2016; and WHEREAS, the Moscow Mayor and City Council held a public hearing regarding this matter on February 16, 2016; and WHEREAS, the annexation described herein has been deemed consistent with Moscow annexation policy set forth in Resolution 2007-01. NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: A parcel of land lying south and including Robinson Park Road situated in Lot 15, of Section 16, Township 39 North, Range 5 West, Boise Meridian, Latah County, State of Idaho and more particularly described as follows: Beginning at an Iron Pipe marking the Southeast Comer of said Lot 15, from which a Brass Cap Monument marking the East Quarter Comer of said Section 16, bears South 26°03'03" East a distance of 1472.52 feet; thence North 89°42'43" West along the South Line of said Lot 15, a distance of 661.39 feet to the Southwest Comer of said Lot 15; thence North 00°39'50" East along the West Line of said Lot 15 a distance of 75.98 feet to the centerline of Robinson Park Road as shown on Moser Estates Fifth Addition, recorded as Instrument Number 410298; thence along a 1250.00 feet radius curve to the left with a central angle of 1°57'3 l an arc length of 42. 73 feet, a chord bearing of North 70°05' 15" East and a chord distance of 42. 73 feet to a point 40 feet ORDINANCE 2016 - 02 PAGE 1 of3 ---PAGE BREAK--- easterly at right angles from the West Line of said Lot 15; thence North 00°39'50" East along a line parallel and 40 feet to the east of the West Line of said Lot 15, a distance of32.61 feet to the North right-of-way of Robinson Park Road; thence North 64°18'07" East along the North right-of-way of Robinson Park Road a distance of 243.23 feet; thence North 61°12'19" East along the North right-of-way of Robinson Park Road a distance of 169.28 feet; thence North 57°37'02" East along the North right-of-way of Robinson Park Road a distance of 89.50 feet; thence North 55°14'23" East along the North right-of-way of Robinson Park Road a distance of 91.29 feet; thence North 52°25'20" East along the North right-of-way of Robinson Park Road a distance of 134.10 feet to a point on the East Line of said Lot 15; thence South 00°30'44" West a distance of 495.25 feet to the Point of Beginning. Described are contains 4.22 acres, more or less. SECTION 2: ANNEXATION: The land described in Section 1 of this Ordinance be and the same hereby is annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which maps are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section 1 of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section 1 of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law.
