DEVELOPMENT AGREEMENT KEVIN AND ADAMS CITY OF MOSCOW, IDAHO THIS DEVELOPMENT AGREEMENT (hereinafter referred to as "Agreement") is entered into this 27thday of October , !99_, by and between Kevin and Adams, husband and wife (referred to as DEVELOPERS), being owners and developers of real property as described herein. and City of Moscow, Idaho, a Municipal Corporation of the State ofldaho, 206 East Third Street, Moscow, ID 83843 (hereinafter referred to as "CITY"); WITNESSETH WHEREAS, DEVELOPERS desire to develop property located within the City of Moscow, Idaho, Area of City Impact being more particularly described as follows A parcel of land located in E 'lz of the SW V. of Section 6, T39N R5W BM Beginning at the southwest corner of the SE V. SW Y4 of said Section 6, point being a brass cap monument: thence N 0"29'l l"E, 967.01 feet along the west line of the SE V. SW V. to the TRUE POINT OF BEGINNING Thence continuing along said line N 0°29' 11" E, 342.04 feet to the center line of an existing county road; Thence along said center line in the following courses N 78°46'36" E, 109.10 feet N 83°17'39" E, II 166 feet N 87°06'57" E, 667.55 to the center line intersection of another county road. Thence along said center line on a curve to the left, 199.66 feet, said curve having a central angle of 38° l l '64", radius= 299.52 chord= 195.98, Thence continuing along said center line S 36°17'22" W, 692.76 feet; Thence leaving said center line N 50°35'25" W, 409.27 feet to the TRUE POINT OF BEGINNING. Parcel contains approximately 724 acres. WHEREAS, DEVELOPERS understand that a waiver of public improvements is available pursuant to the Moscow City Code, but DEVELOPERS specifically do not wish to request such a waiver and wish to enter into the Agreement herein; and WHEREAS, DEVELOPERS enter into this Agreement of their own free will and accord, without coercion and without inducement and at DEVELOPERS' request; and WHEREAS, DEVELOPERS understand that improvements required herein are standards required pursuant to Moscow City Code Title 4, Chapter 8, and are authorized by Idaho Code; and ADAMS DEVELOPMENT AGREEMENT' Page 1 of6 pmcm adarn/sk ---PAGE BREAK--- DEVELOPERS and CITY understand that nothing in this Agreement obligates Latah County to take or to refrain from any action Latah County may wish to take or may wish not to take.
