ORD!NANCE NO. 2001-13 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LAND DESCRIBED IN SECTION 1 OF THIS ORDINANCE BE ANNEXED TO THE CITY OF MOSCOW: PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, land described in Section I of this Ordinance is adjacent on all sides to the City of Moscow, Idaho; and WHEREAS, Idaho Code Section 50-222 authorizes city annexation of land adjacent to the City; and WHEREAS, the owner of land described in Section 1 of this Ordinance has requested that the City annex said land; and NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow, Idaho as follows: SECTION 1: LEGAL DISCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: A tract of land located in the northwest quarter of the northwest quarter of Section 8, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, and more particularly described as follows: Beginning at the northwest comer of said Section 8; thence S88°50'54"E 57.53 feet along the north line of said Section 8 to the easterly right-of-way line of U.S. Highway 95; thence S00°45'37"W 733.05 feet along said right-of-way line to an angle point in the exterior boundary of the proposed Park View Estates Addition to the City of Moscow, Latah County, Idaho, and the TRUE POINT OF BEGINNING of this description; thence S89° 1 T28"E 140.00 feet along said exterior boundary; thence S00°42'32"W 285.00 feet along said boundary to the northwest comer of a parcel of land annexed by the City of Moscow, Latah County, Idaho by Ordinance No.97-17; thence S41 °35 '35"E 111.43 feet along said parcel to the northeast comer of a parcel of land described in Book 139 of Deeds, page 478, on file with the recorder's office of Latah County, Idaho; thence S89°05'29"W 215.33 feel, along the north line of said parcel and the north line of Inscore's Addition to the City of Moscow, Latah County, Idaho as recorded in Book 4 of Plats, page 37 on file with the recorder's oftice of said county, to a point on said easterly right-of-way line of U.S. Highway 95; thence N00°45'37"E 366.66 feet along said right-of-way line to the TRUE POrN! OF BEGINNING. SECTION 2: ANNEXATION: That the land described in Section I of this Ordinance be and the same hereby is, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City maps for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance shall be deemed severable and the invalidity of any provision of this Ordinance shall not affect the validity of remaining provisions.
