NO. 52 2 2 l 2 ·1L- - T1C"''F2: . ecry't:::fl!.il?w..2 / -s ·afl t LM N/ ORDINANCE NO. 2008-07 LAiki COuNTY HEOOflDER AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPO{IO( OF STATE OF IDAHO, PROVIDING THAT LAND DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND GENERALLY SHOWN ON EXHlBIT ATTACHED HERETO AND INCORPORATED BY THIS REFERENCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, land described in Section I of this Ordinance are adjacent to City limits on three sides; and WHEREAS, the land described in Section 1 of this Ordinance have been requested to be annexed by the owner or representative thereof; and WHEREAS, Idaho Code Section 50-222 authorizes City annexation of tracts of land adjacent to the City; and WHEREAS, the Moscow Planning and Zoning Commission held a public hearing regarding this matter on September 12'\ 2007; and WHEREAS, the Moscow Mayor and City Council held a public hearing regarding this matter on May !9'h, 2008; and WHEREAS, the annexation described herein has been deemed consistent with Moscow annexation policy set forth in Resolution 2007-1. NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: A tract of land consisting of the west one half(l/2) of the north one half(l/2) of Lot E of Schumacher's Addition in Latah County, Idaho, recorded as Instrument No. 37010, situated in the northwest quarter of the northwest quarter of Section 9, Township 39 North, Range 5 West, Boise Meridian, and being more particularly described as follows: Commencing at the northwest comer of said Section 9; thence S89° 15' 49"E 30.00 feet along the north line of said Section 9; thence South 30.00 feet to the northwest comer of said Lot E of Schumacher's Addition and the TRUE POINT OF BEGINNING; thence S89°l 5'49"E 300.95 feet along the north boundary of said Lot E; thence N00°44' II "E 60.00 feet along the current City of Moscow corporate limit boundary to a point on the north right-ofIway line of Mountainview Road; thence S89°!5'49"E 13.40 feet along said right-of-way 0Rot>.;;ANCE 2008 07 1026 N MOUNTA1NV!EW Ro ANNEXATION PAGE I of2 ---PAGE BREAK--- line; thence South 178.92 feet to the southeast comer of said west one half ( 1/2) of the north one half (1/2) of Lot E; thence N89°15'49"W 315.12 feet along the south boundary of said Lot E; thence North 118.92 teet along the west boundary of said Lot E to the TRUE POINT OF BEGINNING. Said tract contains 38,297 square teet, more or less. SECTION 2: ANNEXATION: The land described in Section 1 of this Ordinance be and the same hereby are, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section 1 of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section 1 of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law. PASS ED by the City Council and APPROVED by the Mayor this 19'h day of May, 2008.
