ORDINANCE NO. 2001-30 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LANDS DESCRIBED IN SECTION I OF THIS ORDINANCE AND SHOWN ON EXHIBIT HERETO BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, the Moscow Mayor and City Council adopted Resolution 2001-15 which established annexation standards and guidelines creating an annexation policy; and WHEREAS, lands described in Section 1 of this Ordinance and shown on Exhibit hereto are adjacent to and surrounded by the City of Moscow, Idaho; and WHEREAS, Idaho Code Section 50-222 authorizes city annexation of tracts of! and adjacent to and surrounded by the City; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on July 2, 2001; and WHEREAS, the Moseow Mayor and City Council held a public meeting regarding this matter on December 3, 2001; and WHEREAS, the Moscow Mayor and City have determined that annexation of lands described in Section 1 of this Ordinance and shown on Exhibit hereto as Parcel 9 is appropriate and is consistent with Council policy established in Resolution 200 1-15; and NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: Parcel9 That parcel of land described in Warranty Deed No.392299 on file with the Recorder's office of Latah County, Idaho as follows: A tract of land located in the northwest quarter of the southeast quarter of Section 5, Township 39 North, Range 5 West, Boise Meridian. Beginning at a point N0°3WW, along the east 1116'h line of said Section 5, 490.4 feet and S88°57WW 33.0 feet from the northeast corner of the southwest quarter of the southeast quarter of said Section 5 and running thence S88°57WW 222.4 feet; thence N0°8WW 204.8 feet; thence N88°57WE 222.7 feet; thence S0°3WE along the east 1116'h line of said Section 5, 204.8 feet to the point of beginning. ---PAGE BREAK--- SECTION 2: ANNEXATION: The lands described in Section 1 of this Ordinance and shown on Exhibit hereto as Parcel 9 be and the same hereby are, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section 1 of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section I of this Ordinance, shall not affect the validity of remaining provisions or subparts. SECTION 4: EFFECTIVE DATE: This Ordinance shall be effective upon its passage, approval and publication according to law.
