OUTDOOR RANGE USE AGREEMENT I I The City of LeWiston, hereinafter referred to as the "City" and _TJ.JhJ..Ie'--"C""i hereinafter referred to as the "User'', enter into this agreement on the r 4th day of ram wry to provide the terms and conditions for use of the City's Outdoor Police Range. WHEREAS, the City has an Outdoor Police Training Range located on Old Mill Road, Mile Post Marker 2.35, County of Nez Perce, for the members of the City's Police Department and other organizations approved by the City of LeWiston; and, WHEREAS, User is desirous of utilizing the Outdoor Range; and, WHEREAS, the City has approved the User as an acceptable party to use the Outdoor Police Range; and, NOW, THEREFORE, in consideration of the mutual promises, covenants and conditions hereinafter set forth, it is agreed that: 1. There is to be no charges, fees or costs imposed by the City upon the User for the use of the Outdoor Police Range except as may be provided for cleanup. 2. The City of Lewiston gives its consent and grants permission to the User to utilize the Outdoor Police Range at such times and under such terms as provided for by the City Police Department's rules and regulations. Those rules and regulations are attached as Exhibit and are incorporated as though fully set forth herein. 3. The term for this agreement shall be one year and may be extended or renegotiated between the City and the User. This agreement Will be renewed on an annual basis Without action by the City or the User unless the City or the User gives thirty (30) days notice to the other party of the termination of this agreement. 4. User agrees at all times following the use of the Outdoor Range to police and clean the area. This cleanup includes casings, debris and other materials utilized in any exercise con ducted under the terms of this agreement. The City may assess against the User a charge if the City is required to clean the range following the use by User. 5. The User agrees to save and hold harmless and indemnify the City from any and all claims, actions, causes of action or other liability, whether contingent or liquidated, arising out of its use of said premises, pursuant to the terms of this agreement. The User agrees to assume all liability for any injury, bodily or to personal property, which might occur while the User is in possession and utilizing the Outdoor Police Range. 98-02 ---PAGE BREAK--- 6. This agreement may be terminated by the City for the failure of the User to properly police and clean the area or for a violation of the rules and regulations of the Police Department. The City will provide thirty (30) days notice to the User for the breach and termination of this agreement. The termination of the interest of the City under the above lease will result in the termination of all rights and interests of User in this agreement. 7 7.
