449558 WARRANTY DEED KNOW ALL PERSONS BY THESE PRESENTS This warranty deed, between GEORGE B. HATLEY and lOLA HATLEY, the CHARLES & BERNEDA HAMILTON TRUST, Charles Hamilton, Trustee, and VELETTA RAE HATLEY FRINK and 0. EUGENE FRINK, GRANTORS, and CITY OF MOSCOW, a municipal corporation of the State of ldaho, 206 East Third Street, Moscow, Idaho, GRANTEE: Wherefore the GRANTORS in and for valuable consideration does hereby grant, bargain, warrant and convey to the GRANTEE all of GRANTORS' right, title and interest in and to the following described real property located in the city of Moscow, County of Latah, State of Idaho, to wit: A portion of Lot I, Block 3 of the Partial Rcplat of Hatley Addition to the City of Moscow, Latah County, Idaho recorded in Book 6 of Plats, page 91 on file with the Recorder's Office of said county, and said portion being more particularly described as follows: Beginning at the southwest corner of said Lot I, Block 3; thence N00°!0'28"W 192.00 feet along the west boundary of said Lot I; thence leaving said west boundary S88°52'35"E 165.00 feet; thence S23°00'09"E 123.00 teet to the southerly boundary of said Lot I and the northerly right-of-w:y line of Street; thence southwesterly 232.90 feet along said south boundary of Lot I, along a curve concave to the northwest, said curve having a central angle of 50°21'23", a radius of 265.00 feet, and a chord bearing S70°25'3l"W 225.48 feet to the southwest comer of said Lot I and the point of beginning. Said portion contains 33,500 square feet, more or less. to have and to hold the said premises, with their appurtenances unto the said GRANTEE, its heirs and assigns forever, GRANTORS do hereby covenant to and with the said GRANTEE, that GRANTORS are the owners in fcc simple of said premises, and that the premises are free from encumbrances, except those of record, and that the said GRANTORS shall warrant and defend the same from all lawful claims whatsoever. HATLEY and lOLA HATLEY, the CHARLES & BERNEDA HAMILTON TRUST, Charles Hamilton, Trustee, and VELETTA RAE HATLEY FRINK and 0. EUGENE FRINK, (all collectively hereinafter referred to as "Hatley Family"). WHEREAS, Hatley Family owns real property known as Lot 1, Block 3 of the Partial Replat of Hatley Addition in the City of Moscow; and WHEREAS, City desires to purchase a portion of Lot 1, Block 3 (hereinafter "Well Lot") of the Partial Replat of Hatley Addition, more particularly described in Exhibit attached hereto and incorporated herein by reference; and WHEREAS, City has determined it to be in the best interests of its citizens to purchase Well Lot for the construction of a municipal well; NOW THEREFORE, in consideration of the mutual covenants and promises of City and Hatley Family, City and Hatley Family agree as follows: 1. The total purchase price of the Well Lot shall be One Hundred Thousand Dollars ($100,000.00); and 2. Title to the Well Lot shall be conveyed by Warranty Deed to City upon City's payment of one hundred thousand dollars ($1QO.OOO.OO) to Hatley Family; and 3. City and Haltley Family agree that the Well Lot shall be used solely for a municipal well site so long as City owns the Well Lot. Should City determine that the Well Lot is not to be used for a municipal well City may sell the Well Lot and the future owner of the Well Lot may develop the Well Lot property consistent with a use allowable by applicable Federal, State and local laws, statutes, codes, and regulations; and 4. City agrees that well building(s) erected on the Well Lot will be similar in appearance to City's Well 9 building located at the Palouse Empire Mall; and 5. Hatley Family agrees that usual and customary construction activities associated with the construction of a municipal well will be allowed; and 6. City agrees that the Well Lot will not be utilized for outside storage except for the temporary storage of parts and/or equipment for repairs to said municipal well; and 7.
