NO, , 211 AT 'I HE QL:EST OF: C!rpsrv; ? :etivl4 pi pV(j' ORDINANCE NO. 2008-08 lATAH COUNlY HECOHOER AN ORDINANCE OF THE CITY OF MOSCOW, IDAHO, A MUNICIL C'gipo :O OF IDAHO; PROVIDING FOR THE ZONING OF APPROXIMATELY 0,88 ACRES OF PROPERTY DESCRIBED IN SECTION 1 OF THIS ORDINANCE LOW-DENSITY SINGLE FAMILY RESIDENTIAL PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, the lands described in Section I of this Ordinance (subject land) are currently zoned Low-Density Single Family Residential (R-1) within the City of Moscow Area of City Impact; and WHEREAS, the current R-1 Zoning of the subject property is found to be compatible with the applicable Comprehensive Plan Low Density Residential (LR) Land Use Designation and the suitability of the land for residential uses; and WHEREAS, Moscow Planning and Zoning Commission held a duly noticed public hearing and unanimously recommended approval of zoning the subject property R -1 upon annexation to the City of Moscow on September 12'h, 2007; and WHEREAS, the Moscow City Council conducted a duly noticed public hearing and passed a motion to approve this zoning on May 19'h, 2008. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO, AS FOLLOWS: SECTION 1: LEGAL DESCRIPTION: This Ordinance shall apply to the toll owing described lands in Moscow, Latah County, Idaho, to wit: A tract of land consisting of the west one half (112) of the north one half (1/2) of Lot E of Schumacher's Addition in Latah County, Idaho, recorded as Instrument No. 37010, situated in the northwest quarter of the northwest quarter of Section 9, Township 39 North, Range 5 West, Boise Meridian, and being more particularly described as follows: Commencing at the northwest comer of said Section 9; thence S89° 15' 49"E 30.00 feet along the north line of said Section 9; thence South 30.00 feet to the northwest comer of said Lot E of Schumacher's Addition and the TRUE POINT OF BEGINNING; thence S89°15'49"E 300.95 feet along the north boundary of said Lot E; thence N00°44' II "E 60.00 feet along the current City of Moscow corporate limit boundary to a point on the north right-of-way line of Mountain View Road; thence S89°15'49"E 13.40 feet along said right-of-way line; thence South 178.92 feet to the southeast corner of said west one half (1/2) of the north one half (112) of Lot E; thence N89°!5'49"W 315.12 feet along the south Ordinance 2008-08 Zoning Dcsignati<)ll ! 026 N Moumainvkw Rd Page ! of2 ---PAGE BREAK--- boundary of said Lot E; thence North 118.92 feet along the west boundary of said Lot E to the TRUE POINT OF BEGINNING. Said tract contains 38,297 square feet, more or less. SECTION 2: ZONING: That the property described in Section I of this Ordinance be and the same hereby is zoned Low-Density Single Family Residential (R-1) and the City Engineer is hereby ordered to make the necessary amendments the official maps of the City of Moscow which are on file at 221 East 2 nd Street. SECTION 3: SEVERABILITY: Provisions of this Ordinance shall be deemed severable and the invalidity of any provision of this Ordinance shall not affect the validity of remaining provisions. SECTION 4: EFFECT ON OTHER ORDINANCES: Where the definitions contained in this Ordinance are in conflict with relevant portions of City of Moscow, Idaho Municipal Code, the definition contained within those portions of the Moscow Code will be unaffected until such time, if any, as they are amended to be consistent with this Ordinance. SECTION 5: EFFECTIVE DATE: This Ordinance shall be effective upon its passage approval, and publication according to law.
