PROPERTY USE AGREEMENT Project No.:A-012 (001) Project Name: State Highway 8; White Place to South Fork Palouse River Bridge Key No.: 12001 KNOW ALL MEN BY THESE PRESENTS, THAT The City of Moscow hereinafter "Grantors", whose address is 2.-00 e. ord 5-tYe.f+- I H.osc-Ol.AJ ID in consideration of the benefits to be received from the facility to be constructed and other good and valuable consideration the receipt of which is hereby acknowledged, hereby grants unto the STATE OF IDAHO, by and through the Idaho Transportation Board for the Division of Highways, 3311 W. State Street, Boise, Idaho 83703, and its successors and assigns, hereinafter "Grantee", the right to go upon, occupy, and use the following described property: A portion of the property as shown on Exhibit (plan sheet) attached hereto and made a part hereof. For the purpose of constructing a pedestrian handicap ramp at survey station 31 +20.00 to 31 + 70 Right, together with the right and privilege of ingress and egress to and from said property for said purposes. Grantors understand and agree that Grantee may be required to add fill or remove excess soil to match the elevation of the highway. It is expressly intended that these burdens and restrictions shall be in full force and effect and shall bind the Grantors, their heirs, successors and assigns. The Grantors do hereby covenant with the Grantee that they lawfully own and possess the aforementioned and described tract of land, and that they have a good and lawful right to convey such use. GRANTORS /l Signed: Witnessed by: Title: v 2.DIO·lD ---PAGE BREAK--- Memo To: Mayor Nancy Chaney From: Kevin Lilly, City Engineer \LL- Date: March 11, 2010 City of Moscow Public Works Department Re: Idaho Transportation Department: State Highway 8, White Place to South Fork of Paradise Creek Stimulus Project - Property Use Agreement Mayor Chaney, The Idaho Transportation Department (ITO) has an opportunity to apply for an additional stimulus project that would improve the section of State Highway 8 from White Place to Mountain View. To increase their chances of funding, they would like to have the project submitted to lTD Headquarters by Friday, March 12, 2010. lTD District 2 is asking for the permission of the City of Moscow to install an ADA compliant pedestrian approach on the south west corner of the intersection of State Highway 8 and Styner Avenue. While the majority of the ramp will be on State of Idaho Right of Way, a very small fraction of the concrete placed will be on property under the ownership of the City of Moscow. Access to the area via City property will also be required for construction. In this regard, the lTD is asking that the attached Property Use Agreement be signed and returned to their District Office. Please call me if you would like to discuss this matter.
