ORDINANCE NO. 2001-28 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LANDS DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND SHOWN ON EXHIBIT HERETO BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHEREAS, the Moscow Mayor and City Council adopted Resolution 2001-15 which established annexation standards and guidelines creating an annexation policy; and WHEREAS, lands described in Section I of this Ordinance and shown on Exhibit hereto are adjacent to and surrounded by the City of Moscow, Idaho; and WHEREAS, Idaho Code Section 50-222 authorizes city annexation of tracts of land adjacent to and surrounded by the City; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on July 2, 200 I; and WHEREAS, the Moscow Mayor and City Council held a public meeting regarding this matter on December 3, 2001; and WHEREAS, the Moscow Mayor and City have determined that annexation of lands described in Section 1 of this Ordinance and shown on Exhibit hereto as Parcel 6 is appropriate and is consistent with Council policy established in Resolution 2001-15; and NOW THEREFORE, be it ordained by the Mayor and Council of the City of Moscow as follows: SECTION I: LEGAL DESCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: Parce16 A tract of land located in the north half of the southwest quarter of Section 9, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, more particularly described as follows: Beginning at a point S89°24'25"E 30.00 feet and S00°16'55"W 30.00 feet from the northwest comer of the southwest quarter of said Section 9, said point being the intersection of the south right-of-way line of"D" Street and the east right-of-way line of Mountain View Road; thence S89°24'25"E, along said south right-of-way line 1284.06 feet to the northwest comer of the David Brucks Addition to the City of Moscow, of said county and state, as shown on the plat recorded at the office of the County Recorder of said county and state; thence S04°43'33"E, 464.41 feet to the southwest comer of said David Brucks Addition, said point also being the northwest comer of Lot I, Block I of the Skyview Estates Addition ---PAGE BREAK--- to the City of Moscow, of said county and state, as shown on the plat recorded with the County Recorder of said county and state; thence continuing S04°43'33"E 174.64 feet to the southwest comer of said Lot 1; thence N89°48'04"W, 419.64 feet to the northwest comer of Lot 9, Block 3 of said Skyview Estates Addition; thence N87°26'27''W, 100.22 feet; thence N89°40'35"W 0.16 feet to the Northeast comer of the Janson Subdivision in the City of Moscow, of said county and state as recorded in the office of the county Recorder of said county and state; thence N89°27'24"W, along the north line of said Janson Subdivision, 200.00 feet; thence N89°15'45"W, continuing along said north line, 620.00 feet to a point on the east right-of-way line of Mountain View Road; thence N00°16'55"E, along said east right-of-way line, 635.36 feet to the point of beginning. SECTION 2: ANNEXATION: The lands described in Section 1 of this Ordinance and shown on Exhibit hereto as Parcel 6 be and the same hereby are, annexed to the City of Moscow, Idaho and declared a part of the City of Moscow, Idaho; and the Moscow City Engineer is hereby ordered to make the necessary amendments to the official City limits map, zoning map, and Area of City Impact map for the City of Moscow, Idaho, which are on file at City Hall. SECTION 3: SEVERABILITY: Provisions of this Ordinance including every exhibit subpart of Section I of this Ordinance, shall be deemed severable and the invalidity of any provision of this Ordinance including any exhibit subpart of Section I of this Ordinance, shall not affect the validity of remaining provisions or subparts.
