GENERAL RELEASE AND HOLD HARMLESS AGREEMENT FOR USE OF THE VACANT FORMER TAU KAPPA EPSILON (TKE) FRATERNITY HOUSE (745 NEZ PERCE DRIVE) FOR SPECIAL RESPONSE TEAM REGIONAL JOINT TRAINING MARCH 15 THROUGH 17,2005 BETWEEN CITY OF MOSCOW, IDAHO AND REGENTS OF THE UNIVERSITY OF IDAHO KNOW ALL PERSONS BY THESE PRESENTS: City of Moscow, Idaho (hereinafter referred to as "City"), in consideration of use of the vacant former Tau Kappa Epsilon (TKE) House located at 745 Nez Perce Drive, Moscow, Idaho, ("Building") for Special Response Team Regional Joint Training during March 15-17, 2005 ("Training") does hereby agree to defend and indemnify and does hereby release, hold harmless, acquit and forever discharge the Regents of the University of Idaho (hereinafter "Uf') and its successors, assigns, agents, servants, employees and insurers, and all persons acting for, by or through or in any way in behalf of said UI, of and from all legal and equitable claims, of every kind, actions, causes of action, judgments, damages, liabilities and demands of whatsoever kind, name, or nature, known or unknown, contingent or mature, in any way having to do with, arising, having arisen, to arise, or which may arise out of or by reason of Training, which results in or relates to, in any way, any injury suffered or incurred during or as a result of such Training at Building. City specifically acknowledges that this General Release and Hold Harmless Agreement is entered· into with the knowledge that Building is vacant and may contain dangerous or hazardous conditions, latent or patent (including lead-base paint and asbestos) and this General Release and Hold Harmless Agreement is intended to serve as a waiver of all claims that may arise out of harm, damage, or injuries suffered during Training and the undersigned agrees that UI has informed City of such conditions prior to entry onto the premises and Building. City agrees to secure the Building after completion of Training and to remove materials brought to Building for Training. City agrees not to damage the premises beyond the general condition existing at the time of entry onto the premises and Building and agrees to be responsible for such damage to Building.
