RESOLUTION NO. 2014-09 A RESOLUTION OF THE CITY OF MOSCOW, IDAHO, A MUNICIPAL CORPORATION OF THE ST ATE OF IDAHO, ADOPTING THE AMERICANS WITH DISABILITIES ACT (ADA) 2010 STANDARDS FOR ACCESSIBLE DESIGN AND THE JULY 26, 2011, DRAFT OF THE ADA PROPOSED ACCESSIBILITY GUIDELINES FOR PEDESTRIAN FACILITIES IN THE PUBLIC RIGHT-OF-WAY; PROVIDING THIS RESOLUTION TO BE EFFECTIVE UPON ITS PASSAGE AND APPROVAL ACCORDING TO LAW. WHEREAS, the Federal government enacted the Americans with Disabilities Act of 1990 (ADA) to prevent discrimination of the physically and mentally disabled relating to employment and access to public facilities; and WHEREAS, Title II of the ADA requires that municipalities adopt the Americans with Disabilities Standards for Accessible Design that promote and provide accessibility, through structural modifications to assist in removing accessibility barriers where possible; and WHEREAS, Title II of the ADA recommends that municipalities adopt an ADA Accessibility Guideline for Pedestrian Facilities in the Public Right-of-Way that provides accessibility, through structural modifications to remove accessibility barriers; and WHEREAS, the City remains committed to the ADA and the elimination of barriers to public facilities; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City as follows: The City adopts the Americans with Disabilities Act (ADA) 2010 Standards for Accessible Design and the July 26, 2011 Draft of the ADA Proposed Accessibility Guidelines for Pedestrian Facilities in the Public Right-of-Way, copies of which shall be filed with and maintained by the City Clerk.
