RESOLUTION 2009 - 13 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AUTHORIZING THE DESIGNATION OF AN APPROXIMATELY 0.23 ACRE PROPERTY LEGALLY DESCRIBED HEREIN AND AS SHOWN ON EXHIBIT ATTACHED HERETO, AND INCORPORATED HEREIN BY THIS REFERENCE, AS LOW DENSITY RESIDENTIAL (LR); PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW. WHEREAS, the owner of the subject prope1ty has requested annexation of the subject land within the City of Moscow; and WHEREAS, in accordance with Idaho Code, the City must detem1ine the appropriate Comprehensive Plan Land Use Designation for the subject property upon annexation; and WHEREAS, the subject property is currently located within the City of Moscow Area of City Impact and is designated as Low Density Residential (LR) upon the City of Moscow Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission after the conduct of a public hearing on April 22, 2009 recommended that the Comprehensive Plan Land Use Designation of the subject property remain Low Density Residential (LR) upon annexation into the City of Moscow; and WHEREAS, the Mayor and City Council held a public hearing on this matter on June 15\ 2009 and passed a motion to approve the continued designation of the subject property as LR upon Annexation; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Moscow, Idaho as follows: That the Comprehensive Plan Land Use Designation of the 0.23 acres legally described below remain designated as Low Density Residential upon annexation into the City of Moscow Idaho. Subject Property: A parcel of land located in the NW1/4SE1/4 and the SW1/4SE1/4 of Section 9, T39N R5W, BM and being more particularly described as follows: Beginning at the northeast comer of the SW1/4SE114 of Section 9 and the TRUE POINT OF BEGINNING: Thence S 0°29'30" W, 60.00 feet, along the east line of said SW1/4SE1/4 of Section 9, to the northeast comer of Rolling Hills 71h Addition to the City of Moscow; Thence N 89°30'24" W, 242.37 feet, along the north line of said Rolling Hills 7111 Addition; Resolution 2009-13 McGurkin-Comprehensive Plan Land Usc Designation June l si, 2009 Page I of3 ---PAGE BREAK--- Thence leaving said north line, N 69°12'15" E, 132.71 feet; Thence N 77°18'21" E, 57.22 feet; Thence N 81 °16'20" E, 63.83 feet, to a point on the east line of the NW1/4SE1/4 of Section 9; Thence S 0°29'30" W, 1 1.47 feet, along said line to the TRUE POINT OF BEGINNING. Parcel contains 0.23 acres, more or less (1 0,207 square feet±) PASSED by the City Council and APPROVED by the Mayor this 1st day of June, 2009.
