RESOLUTION 97-19 A RESOLUTION DECLARING THAT CERTAIN REAL PROPERTY DESCRIBED HEREAFTER IS A "SLUM, BLIGHTED, DETERIORATED OR DETERIORATING AREA", DESCRIBING THE BOUNDARIES OF SUCH AREA, GENERALLY DESCRIBING THE CONDITIONS OF SLUM AND BLIGHT, AND IDENTIFYING AND DOCUMENTING TWO OR MORE IMPROVEMENTS THROUGHOUT THE AREA WHICH ARE IN A GENERAL STATE OF DETER! ORATION, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the desire of the City Council to make a concerted effort to aid in the prevention and/or elimination of slums or blight on an area basis within the City of Moscow, Idaho; and WHEREAS, there exists an area within the City of Moscow, Idaho which meets the definitions of an area of slum, blighted, deteriorated or deteriorating area; and WHEREAS, such area is described generally as the area in the vicinity of U.S. Highway 95 between Lewis Street and Sweet Avenue as indicated on the attached maps; and WHEREAS, this slum, blighted, deteriorated or deteriorating area is one which can be prevented or eliminated by the proper expenditure of funds allocated by the Idaho Community Development Block Grant Program (ICDBG) or the expenditure of other funds; and WHEREAS, the rules and procedures for the awarding of are established by AD AP A 48, Title 1; and WHEREAS, it is the desire of the City of Moscow, Idaho to declare an area slum, blighted; and/or declare an area deteriorated and/or deteriorating because such an area exists within the City of Moscow, Idaho and because such an area must be declared by resolution of the City Council of Moscow, Idaho to be eligible for the receipt of an ICDBG to prevent or eliminate such an area; and WHEREAS, there must be identified and documented a substantial number of deteriorated or deteriorating buildings or public improvements throughout the area; and WHEREAS, there exist two or more public improvements throughout the area which are in a general state of deterioration as identified herein; and WHEREAS, the area designated herein, in part, requires the improving of the community infrastructure to accommodate economic growth and eliminate health and safety problems. RESOLUTION 97-19 Page 1 of2 ---PAGE BREAK--- NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF CITY OF MOSCOW, IDAHO. SECTION 1• That City Council of City of Moscow, Idaho hereby declares the real property described in Exhibit attached hereto and made a part hereof, as a "deteriorating area" as defined in the Housing and Community Development Act of 1974 as amended (42 USC, Section 5301) and/or Department of Housing and Urban Development Rules 24 CFR Parts 570, subpart L SECTION 2 That the City Council of the City of Moscow hereby makes the following finding regarding the slum, blighted, deteriorating or deteriorated area within the City of Moscow described at Section 1 immediately above• A The sanitary sewer trunk line is inadequate to handle peak discharge flowing through this area during flooding situations. B. Facilities for pedestrians and bicycles are severely inadequate on streets. C. Water lines are undersized through this area. SECTION 3 • The area designated herein above at Section I is hereby declared to be a slum, blighted, deteriorated or deteriorating area in the City of Moscow, Idaho for any and all legal purposes including but not limited to those purposes related to the process and procedures for the application for and the awarding of Idaho Community Development Block Grants. SECTION 4• That this resolution take effect and be in full force from and after its passage and approval. PASSED by the City Council and APPROVED by the Mayor this 17'h day of November, 1997. Gi F.
