RESOLUTION NO. 2007 • 05 A RESOLUTION OF THE CITY OF MOSCOW, LATAH COUNTY, IDAHO SETTING A PUBLIC HEARING ON THE MATTER OF WHETHER THE CITY COUNCIL SHOULD FILE OF A PETITION FOR JUDICIAL CONFIRMATION OF THE CITY'S AUTHORITY TO ISSUE AND SELL CERTAIN REVENUE BONDS TO FINANCE REQUIRED IMPROVEMENTS TO THE WASTEWATER TREATMENT FACILITIES CITY OF MOSCOW LATAH COUNTY, IDAHO BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSCOW, LATAH COUNTY, IDAHO, as follows: WHEREAS, the City of Moscow, Latah County, Idaho ("City"), is a municipal corporation of the State of Idaho, created and existing under the Constitution and laws of the State of Idaho; and WHEREAS, pursuant to Idaho Code §7-1302 et seq., the City may seek judicial confirmation of the City's authority to issue and sell certain revenue bonds to finance the required improvements to the City's Sewer System Facilities as an ordinary and necessary expense of the City of Moscow; WHEREAS, Idaho Code §7-1304(3) requires the City Council to conduct a public hearing on the matter of whether a Resolution authorizing the filing of a Petition for Judicial Confirmation should be adopted by the Council, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOSCOW, LATAH COUNTY, IDAHO as follows: Section 1: PUBLIC HEARING The Council hereby calls for a public hearing on matter of whether a resolution authorizing the filing of a Petition for Judicial Confirmation should be adopted by the Council for Monday, April 16, 2007 at 7:00 o'clock PM at City Hall Council Chambers, 206 East Third Street, Moscow, Idaho, 83843. Section 2: PUBLICATION OF NOTICE OF HEARING The City Clerk is directed to publish notice of the time, place and summary of the matter to be heard at said public hearing in the official newspaper of the City at least fifteen (15) days prior to the hearing date. The notice shall be in the form attached as Exhibit A and shall be posted in a prominent place at or near the main door of City HalL Resolution 200705 Notice of Public Hearing to Consider Judicial Confirmation for WWTP March 2007 Page J ---PAGE BREAK--- Section 3: AVAILABILITY OF PROPOSED ORDINANCE FOR PUBLIC REVIEW A copy of the proposed Resolution authorizing the filing of a petition to seek judicial confirmation of the City's authority to issue and sell certain revenue bonds to finance required improvements to the City's wastewater treatment facilities shall be available for public review in the offices of the City Clerk during the fifteen (15) days prior to the public hearing. Section 4: EFFECTIVE DATE This Resolution shall be effective from and after its adoption. PASSED AND ADOPTED this 19th day of March, 2007.
