ORDINANCE NO. 2003- 13 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, PROVIDING THAT LANDS DESCRIBED IN SECTION l OF THIS ORDINANCE, BE REZONED FROM INDUSTRIAL AND RESIDENTIAL/OFFICE (RO) ZONING DISTRICT TO GENERAL BUSINESS (GB) ZONING DISTRICT; PROVIDING THAT THE OFFICIAL ZONING MAP FOR THE CITY OF MOSCOW BE AMENDED ACCORDINGLY; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. WHRERAS, the Moscow Planning and Zoning Commission held a duly noticed public hearing and recommended approval of this rezoning on May 14, 2003; and WHEREAS, the Moscow Mayor and City Council held a duly noticed public hearing on this rezoning on June l6,2003;and WHEREAS, lands described in Section l of this Ordinance are adjacent to lands zoned General Business (GB), Industrial and Residential Office (RO) Zoning Districts; and WHEREAS, lands described in Section I of this Ordinance are designated, Industrial and Public on the Comprehensive Plan Map; and WHEREAS, the proposed General Business (GB) zoning is in conformance with the Moscow Comprehensive Plan Industrial and Public land use designations because said plan states that "An area may be zoned for a lower intensity than is indicated by this plan but should not be zoned for a more intense use" and said plan indicates that the Public land use designation is appropriate for lands intended to be used for public services as necessary for the community; and; WHEREAS, the proposed General Business (GB) zoning is a zoning district for uses that are lower in intensity than industrial uses; and WHEREAS, the intended use of the subject lands is an expansion of the community's primary health care facility which is deemed a public service necessary for the community. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF MOSOCW, IDAHO AS FOLLOWS; SECTION I: LEGAL DISCRIPTION: This Ordinance shall apply to the following described lands in Moscow, Latah County, Idaho, to-wit: Lots 3, 4, 5, 6, 7. 8, 9, 10, 11, 12 and the easterly 65' of Lot 13, Block I of the Sunnyside Addition and Lots I, 2, 3 and 4 of Block I 0 of the Sunnyside Addition. SECTION 2; ZONING. The lands described in Section I of this Ordinance be and the same hereby are, rezoned as follows: Lots 3, 4, 5, 6, & 7 of Block 1 of Sunnyside Addition are rezoned from Industrial(!) Zoning District to General Business (GB) Zoning District; Lots 8, 9, 10, 11, 12 & the easterly 65 teet of Lot l 3 of Block I of the Sunnyside Addition arc rezoned from Residential Ontce (RO) Zoning District to General Business (GB) Zoning District; Lots 3 & 4 of Block 10 of the Sunnyside Addition are rezoned from Residential Office (RO) Zoning District to General Business (GB) Zoning District; Lots I & 2 of Block 10 of the Sunnyside Addition are rezoned from Industrial(!) Zoning District to General Business (GB) Zoning District; and the City Engineer is hereby ordered to make the amendments to the official City maps for the City of Moscow, Idaho, which are on tile at City Hall. Ordln,mcc 2003-13 Pagl'! of2 ---PAGE BREAK--- SECTION 3: SEVERABILITY: Provisions of this Ordinance shall be deemed severable and the invalidity of any provision of this Ordinance shall not affect the validity of remaining provisions. SECTION 4: EFFECTIVE DATE: This Ordinance shall be etfective upon its passage, approval and publication according to law. PASSED by the City Council and APPROVED by the Mayor this 16'h day June 2003.
