ORDINANCE NO. 2000-04 AN ORDINANCE OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF IDAHO; PROVIDING THAT LAND DESCRIBED IN SECTION I OF THIS ORDINANCE BE ANNEXED TO THE CITY OF MOSCOW; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE BE DEEMED SEVERABLE; PROVIDING FOR THIS ORDINANCE BE TO BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW WHEREAS, lands described in Section I of this Ordinance are adjacent to the City of Moscow; and WHEREAS, the owners of said land have requested the City to annex said lands; and WHEREAS, Idaho Code Section 50-222 authorizes city annexation of land adjacent to the City with or without the request of the landowner; and WHEREAS, the lands described in Section 1 of this Ordinance can be served by City sewer and City water; and WHEREAS, the City of Moscow Planning and Zoning Commission held a duly noticed public hearing on this annexation on January 26, 2000 and recommended that the Moscow City Council approve this annexation. WHEREAS, the Moscow City Council held a duly noticed public hearing on this annexation on February 22, 2000. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF MOSCOW, IDAHO AS FOLLOWS SECTION 1 LEGAL DESCRIPTION. This Ordinance shall apply to the following described parcel of land located in Moscow, Latah County, Idaho, to-wit A parcel of land located in the northwest quarter of Section 8, Township 39 North, Range 5 West, Boise Meridian, Latah County, Idaho, and more particularly described as follows: Beginning at the northeast corner of said northwest quarter of Section 8; thence N88°50'54"W 767.89 feet along the north line of said Section 8 to a point on the east right-of-way line of Polk Street and the TRUE POINT OF BEGINNING; thence S00°59'31 "W 776.89 feet along said right-of-way line to a point on the existing Moscow city limit boundary; thence following said city limit boundary N89°05'29"W 60.00 feet to a point on the west right-of-way line of Polk Street; thence S00°59'31" 141.35 feet along aid right-of-way line to the southeast corner of the Moscow City Shop tract described in Warranty Deed No. 435155 on file with the recorder's office of said Latah County; thence N88°58'29"W 349.67 feet along said City Shop tract boundary; thence SOI001"31"W 474.47 feet to the Ordinance 2000-04 Page I of2 ---PAGE BREAK--- southeast corner of said City Shop tract; thence N89°05'29"W 150.05 feet to the southwest corner of said tract; thence N00°59'31 "E 624.47 feet to the northwest corner of said tract; thence S89°05'29"E 500.00 Feet to the northeast corner of said tract and a point on the west right-of-way line of Polk Street; thence N00°59'31 "E 767.79 feet along said right-of-way line to a point on the north line of said Section 8; thence leaving said city limit boundary S88°50'54"E 5.47 feet along said north line to the southeast corner of the Hovey tract described in Warranty Deed No. 410877 on file with said recorder's office; thence following the east boundary of said Hovey tract N07°56'31"W 9.91 feet along the west right-of-way line of Polk Street to a point on said existing city limit boundary; thence N82°03'29"E 65.00 feet along said city limit boundary to a point on the east right-of-way line of Polk Street, said point being the southwest corner of Lot 3 of the Peterson - Williams Subdivision plat recorded in Book 6 of Plats, page 99 of said recorder's office; thence leaving said city limit boundary SOT56'3l "E 20.31 feet along said east right-of-way line (extended) to a point on said north line of Section 8; thence N88°50'54"W 11.30 feet along said north line to the TRUE POINT OF BEGINNING. Said tract contains 4.45 acres, more or less. SECTION 2 ANf\.'EXA TION. That the lands described in Section I of this Ordinance be and the same hereby are, annexed to the City and declared a part of the City of Moscow. SECTION 3: SEVERABILITY Provisions of this Ordinance shall be deemed severable and the invalidity of any provision of this Ordinance shall not affect the validity of remaining provisions. SECTION 4: EFFECTIVE DATE. This Ordinance shall be effective upon its passage, approval and publication according to law.
