RESOLUTION 2016 - 08 A RESOLUTION OF THE CITY OF MOSCOW, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AUTHORIZING THE DESIGNATION OF THIRTY (30 ) ACRES OF PROPERTY LEGALLY DESCRIBED HEREIN AND AS SHOWN ON EXHIBIT ATTACHED HERETO, AND IN CORPORA TED HEREIN BY THIS REFERENCE, AS AUTO URBAN RESIDENTIAL (AU-R) ; PROVIDING THAT THIS RESOLUTION BE IN EFFECT UPON ITS PAS SAGE AND APPROVAL. WHEREAS, the owner of the subject property has requested annexation of the subject land within the City of Moscow; and WHEREAS, in accordance with Idaho Code, the City must determine the appropriate Comprehensive Plan Land Use Desig nation for the subject property upon annexation; and WHEREAS, the subject property is currently located within the City of Moscow Area of City Impact and is desig nated as Auto-Urban Residential (AU-R) upon the City of Moscow Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission, after conducting a duly noticed public hearing on April 27 , 2016, and recommended that the Comprehensive Plan Land Use Desig nation of the subject property remain Auto-Urban Residential (AU-R) upon annexation into the City of Moscow; and WHEREAS, the Moscow City Council conducted a public hearing on May 16, 2016 and passed a motion to approve the continued desig nation of the subject property as Auto-Urban Residential (AU-R) upon Annexation. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Moscow, Idaho as follows: That the Comprehensive Plan Land Use Desig nation of the thirty (30 ) acres leg ally described below, remain desig nated as Auto-Urban Residential (AU-R) upon annexation into the City of Moscow, Idaho. LEGAL DESCRIPTION: A parcel of land located in the Northwest Quarter of the Northeast Quarter of Section 9 , Township 39 North, Rang e 5 West, Boise Meridian, Latah County, State of Idaho and more particularly described as follows: Beginning at a brass cap monument marking the North Quarter Comer of said Section 9, from which a brass cap monument marking the Northeast Comer of said Section 9, bears South 89°22'17" East a distance of 2648.74 feet; thence South 89°22'17" East along the North Line of said Section 9, a distance of 140.00 feet to a 5/8 inch rebar with a PLS 9584 cap; thence South 00°37'43" West a distance of 108.53 feet to a 5/8 inch rebar with a PLS 9584 cap; thence North 80°49'46" East a distance of 20.30 feet to a RESOLUTION 2016 - 08 MAY2016 PAGE I OF3 ---PAGE BREAK--- 5/8 inch rebar with a PLS 9584 cap; thence North 00°37'43" East a distance of 105.07 feet to a 5/8 inch rebar with a PLS 9584 cap on the North Line of said Section 9; thence South 89°22'17" East along the North Line of said Section 9 a distance of 834.55 feet to 5/8 inch rebar with a PLS 9584 cap; thence South 00°08'23" West a distance of 1314.96 feet to a5/8 inch rebar with a PLS 9584 cap on the South Line of the Northwest Quarter of the Northeast Quarter of said Section 9; thence North 89°29'31" West along said South Line a distance of 994.53 feet to a 5/8 inch rebar with a PLS 9584 cap marking the Center-North 1/16 Comer of said Section 9; thence North 00°08'23" East along the North-South Center Section Line a distance of 1317 .05 feet to the Point of Beginning. Containing 30.00 Acres, more or less. PASSED by the City Council and APPROVED by the Mayor this 16th day of May, 2016 .
