IDAHO TRANSPORTATION DEPARTMENT LOCAL PROFESSIONAL SERVICES AGREEMENT Agreement Number 6827 THIS AGREEMENT is made and entered into this / day of Oc/-uf::>-er- 20 07 , by and between the CITY OF MOSCOW, whose address is PO Box 9203, Moscow, ID 83843-1703, hereinafter called the "Sponsor," and Riedesel & Associates, Inc., whose address is 77 Southway Ave., Suite C, Lewiston, ID 83501, hereinafter called the "Consultant." RATIFICATION The Idaho Transportation Department, representing the Federal Highway Administration on all local federal-aid highway projects, is authorized to ratify all agreements for engineering services entered into between sponsoring local agencies and their retained consultants. All references to State used hereafter shall denote the Idaho Transportation Department. DUTIES AND RESPONSIBILITIES OF CONSULTANT A. DESCRIPTION OF WORK Agreement 6827 Page 2 The Consultant shall provide professional services as outlined in the attachment(s) and as further described herein. 1. The following attachments are made a part of this Agreement: a. Attachment No. 1 is the Consultant CADD Specifications and the negotiated Scope of Work, Cost Estimate, Man-Day Estimate. b. Attachment No. 2L is the Consultant Agreement Specifications which are generic to all agreements. In the case of discrepancy, this Agreement shall have precedence over Attachment No. 1, and Attachment No. l shall have precedence over Attachment No. 2L. 2. Aerial photography negatives and other items as identified in Section J, Paragraph 9 of the Consultant Agreement Specifications shall be sent to Greg Mead, Idaho Transportation Department, P.O. Box 7129, Boise, ID 83707. 3. Per Diem will be reimbursed at the current approved rates. These rates are listed at http://www.itd.idaho.gov/designlcau!policies/policies.htm. IV. DUTIES AND RESPONSIBILITIES OF SPONSOR AND/OR STATE The Sponsor and/or State shall provide to the Consultant, upon request, copies of any records or data on hand which are pertinent to the work under the Agreement. V. TIME AND NOTICE TO PROCEED A. The Consultant shall start work under this Agreement no later than ten (l 0) calendar days from the receipt of the written NOTICE TO PROCEED. The Consultant shall complete all work by 07/02/2008. B. The Consultant shall remain available to perform additional work for an additional sixty (60) days or until the Agreement is closed out, whichever comes first. VI. BASIS OF PAYMENT A. Payment Basis: Cost Plus Fixed Fee - Consultant agrees to accept as full compensation for all services rendered to the satisfaction of the State for completion of the work, the lesser of the actual cost plus the fixed fee or Not-To-Exceed amount of the Agreement. ---PAGE BREAK--- B. Reasonable increases in labor rates during the life of this Agreement will be accepted. Payroll additive rate, general administrative overhead rate, and unit prices are subject to adjustment during the life of this Agreement based on audit and negotiations. If the State approves an adjustment to the overhead rate or unit prices, the Consultant must then submit a written request to the Agreement Administrator requesting use of the approved rate( s) on this agreement. If the new rate( s) are accepted by the Agreement Administrator, they shall apply from the date the written request was made to the Agreement Administrator. An adjustment shall not change the Not-To­ Exceed amount of the Agreement. For projects of duration greater than two years, the Not-To-Exceed amount may be negotiated. In no case will rates be adjusted more than once per agreement year. F. PSA No. I is issued in the amount of $50,000.00 to begin the work of this Agreement. Pedestrian Path, Sweet Ave. to Blaine St., Moscow Project No. A009 (756) Key No. 09756 Project Description The Pedestrian Path, Sweet Ave. to Blaine St. Project is a federally and locally funded enhancement project, partially located on abandoned railroad property. The project will construct a paved 8'-10' multi-use pathway adjacent to Paradise Creek from U.S. 95 at Sweet Avenue east to Bem1an Creekside Park. An existing 10' paved pathway runs through the park east on the abandoned rail bed to State Highway 8 at Blaine Street. In addition pedestrian lighting and minor landscaping will be installed along portions of the trail. Four 10-foot wide paved connections to pedestrian crossings at Styner Avenue and Blaine Street will be constructed. The project is anticipated to include the following work items: • Clearing and Grubbing: The new path between U.S. 95 at Sweet Avenue and Berman Creekside Park currently consists of grass, weeds, and Cottonwood trees that need to be removed. Much of this area is located adjacent to Paradise Creek. • Pathway: A new ADA accessible 8'-12' wide pathway adjacent to Paradise Creek in the City of Moscow from the junction of US-95 and Sweet A venue to the junction of SH-8 and Blaine Street. Approximately 1500' will be constructed adjacent to US 95 and Paradise Creek and will. meander to serve as a connector to Berman Park. Also, approximately 325' of 1 0-foot wide, ADA compliant pathway will be constructed where the pathway intersects Styner and Blaine Street and will provide pedestrian access to cross walks. • Lighting: Lighted Bollards will be installed at a mounting height of 4 feet, and a typical spacing of 100 feet along existing and proposed pathways within the project limits. • Landscaping: Minor landscaping, fencing, and several benches will be installed along the pathways within the project limits. The project design will reflect the following assumptions: • This project will be completed following lTD's complex project design process for special projects. • Preliminary Design Review is excluded. • Right-of-Way plans are excluded. The City will coordinate and execute easements with the adjacent landowners as needed and complete the Right of Way Certification. • All work will be completed within ITD right-of-way, City of Moscow easements, or City of Moscow property. • A Programmatic Categorical Exclusion will be required for Environmental Clearance. • The project will be completed in US Customary Units. Key# 09756 Page 1 of 10 8/10/2007 ---PAGE BREAK--- • A Combined Phase IIIIJIN Materials Reports will be completed. • No utility conflicts are anticipated, other than adjusting surface utilities (water valves, manhole lids etc.). • Landscape design will be done by City of Moscow and Riedesel Engineering will detail out the design on the plans and in the specifications. • The Concept Report will be completed by the City of Moscow. • Lighting will be decorative only. Project Milestone Schedule • Notice to Proceed- 08/29/2007 • Environmental Final Submittal 02/19/2008 • Final Design Review Submittal- 04/21/2008 • PS&E - 06/02/2008 Task 1 -Surveying 1.1 Topographic Survey TASK OUTLINE It is expected that one field meeting, upon commencement of the design work, will be required during this phase of the project. The Project Manager and Engineer will visit the project site with essential City staff, including the surveyor, and review the basis of control, general survey approach, location of monuments, utilities and other physical features. All surveying for the project will be completed in English units on the State Plane Coordinate System, adjusted to the project datum. The topographic survey will collect all ground features throughout the project limits (for construction of the pathway and retaining walls), including but not limited to, centerline, edge of pavement, top and bottom of curb, sidewalks, bridges, ditches, trees, utilities (both above and below ground), storm drainage discharge points, and all other pertinent features relevant to the design of the project and on 50-foot stations. The survey will be performed by Surveyors West and will be coordinated by Riedesel Engineering. Task 2- Material Reports This scope of work describes Riedesel Engineering's work in coordination with the Material Reports. The subconsultant's scope of work is located in Exhibit B. 2.1 Combined Phase IIIIIIN Soils Investigation, Pavement Estimating and Special Provisions Report (See also Geotechnical Scope of Work) A Combined Phase II, III and V Report will be prepared in coordination with the Geotechnical Sub-consultant for this project. Draft Combined Phase Il/IIIN Report: The Phase III portion of the report will be completed by Geotechnical Sub-consultant. Riedesel Engineering will draft the typical sections for inclusion in the Phase III portion of the combined report. Riedesel Engineering will provide recommendations for preparation of the Phase V Special Provisions portion of the combined report. This portion of the report will provide modifications to existing standard specifications, special provisions for materials and/or construction activities not covered in the standard specifications, and contractor notes, as appropriate. B. Revised Phase IIIIIIN Report: Comments from the Phase II/IIIIV report review will be incorporated into the report and be resubmitted to the City of Moscow and then forwarded to lTD for approval. C. Consultation and Meetings: Consultation with the Design Team, lTD and the City will be conducted on a frequent basis throughout the Combined Phase II, III and V work and includes one review meeting with the City of Moscow, Geotechnical Sub-consultant, and ITD for the Combined Phase Il/IIIIV Report. Task 3 - Environmental Clearance It is anticipated that this project will qualify as a documented categorically excluded project as described by implementing rules and regulations of the National Environmental Policy Act. Environmental impacts that could be investigated include the following: "Hazmat" Risks Threatened/Endangered Species Wetlands Cultural!H i stori cal Sole Source Aquifer Water Quality, Runoff lmpacts NPDES -General Permit Riedesel Engineering will utilize sub-consultants to perform portions of the work. CREX Consulting will complete the Threatened, Endangered Species Analysis, Resource Planning Unlimited will complete the wetland investigation, and Lee Sappington will complete the Archeological and Cultural Resource Survey. 3.1 Conduct Field Review Riedesel Engineering will conduct a site review of the project with the sponsor's representatives and document findings. Key# 09756 Page 3 of 10 8/10/2007 ---PAGE BREAK--- 3.2 Review Existing Data A review of existing data and studies will consist of project plans, data, and layouts completed for this project. 3.3 Correspondence with Agencies Riedesel Engineering will compile a contact list of agencies relevant to the environmental evaluation of the project and gather input from the sponsor and lTD. A project description and letter requesting agency preliminary review will be drafted and sent to those on the list. The list will include representatives from the City, lTD, DEQ, and IDF&G. Agencies contacts will be followed up with individual phone calls. 3.4 Prepare lTD 652 The lTD 652, Hazardous Material Administrative Review will be prepared. Work will include review of public records to investigate potential for waste items listed on the form. 3.5 Prepare lTD 2784 The lTD 2784, NPDES Storm Water Permit Checklist for Construction will be prepared based on estimated construction activities. Prepare a narrative of mitigation measures for construction storm water quality control. 3.6 Wetland Delineation Coordination Riedesel will coordinate completion of the Wetland Delineation with Resource Planning Unlimited, whose scope of work is attached as Exhibit C. Riedesel will complete any mapping required to establish wetland boundaries, if found. 3. 7 Endangered Species Analysis Coordination CREX Consulting will complete the Endangered Species Analysis, as shown on their scope of work in Exhibit D. Riedesel will coordinate work activities and review and transmit submittals for this portion of the evaluation. 3.8 Sole Source Aquifer Riedesel Engineering will coordinate with EPA regarding Sole Source Aquifer regulations and requirements on the project. 3.9 Cultural Resource Survey Coordinating Lee Sappington will complete the Cultural Resource Survey, see Exhibit E. Riedesel Engineering will coordinate work activities and review and transmit submittals. 3.10 Prepare lTD 654 Key# 09756 Page 4 of 10 8/10/2007 ---PAGE BREAK--- The ITD 654, Environmental Evaluation will be prepared based on evaluated material. Complete the narrative report to accompany the lTD 654, including a Summary of Impacts and a Mitigation Summary. 3.11 Prepare Exhibits Maps, charts or exhibits substantiating environmental investigations and documentation work will be prepared as required. Project conceptual maps will be provided by the City of Moscow in electronic form to assist in creation of the maps. 3.12 Assemble & Submit Evaluation for Review Environmental information will be assembled under a common cover and submitted to lTD District 2 for review and documentation. 3.13 Final Corrections and Resubmittal Any corrections required will be made and the document resubmitted to lTD District 2 for final review. 3.14 Liaison and Conferences The Project Manager will administer work assignments and monitor progress for all Environmental activities, initiate regular meetings with ITD and the City of Moscow to keep them informed of the progress and status of the project environmental activities. It is anticipated that up to two meetings will be required located in the City of Moscow. Task 4 -Preliminary Design 4.1 Prepare Vicinity Map An initial vicinity map will be provided by the City of Moscow. This map will show the limits of the project, project number, and milepost limits. The vicinity map will be used with reports and letters for the project. 4.2 Prepare Typical Section Typical sections will be completed, based on the approved concept report, depicting the pathway section, limits of removals, depth of pavements, profile grade, cut and fill slope orientation. 4.3 Reduce Field Notes The field survey information will be placed in a comma delineated PNEZD format in electronic files. The files will be merged into a single data file. This topographic file will be the basis of presentation mapping and final plans. The field notes will be reduced by Riedesel. 4.4 Prepare Base Maps Base maps showing the topographic features will be prepared via CAD, The base maps Key# 09756 Page 5 of 10 8/10/2007 ---PAGE BREAK--- will be prepared by Riedesel, showing the features of survey area, including utilities, sidewalks, buildings, curbs, surface features, etc. 4.5 Prepare Triangular Irregular Network (TIN) A terrain model will be developed for the project area. This model will be the basis for establishing alignment, grade, and earthwork quantities. 4.6 Set Pathway Horizontal and Vertical Alignment The horizontal alignment will be finalized based on the existing easement alignment and monumentation. The vertical profile will be refined and set in a manner that uses on-site materials most efficiently and matches existing features. 4. 7 Preliminary Earthwork Studies Earthwork calculations will be completed after the profile and the alignment are established. The alignment will then be adjusted to provide that which is the most cost effective. 4.8 Landscaping Riedesel will coordinate completion of landscape design with City of Moscow. 4.9 Electrical Riedesel will layout conduit and light spacing coordinate completion of the electrical design with Infinity Engineering, whose scope of work is attached as Exhibit F. 4.10 Preliminary Utility Contacts Initial contact letters, including vicinity map and sketches will be sent to appropriate utilities requesting information regarding location and possible conflicts throughout the project area. 4.11 Prepare Plans & Exhibits & Hold a Public Information Meeting Key# 09756 A public hearing is not anticipated. If required, a public hearing will be held under a supplemental agreement. Materials necessary to conduct a public information meeting will be furnished by Riedesel Engineering, Inc., including plans, exhibits, and various handouts for portions of the work included in this scope. The City of Moscow will arrange for a meeting place in Moscow, Idaho and organize and advertise the meeting. Design team members will be present to provide information to the public and answer questions. Essential representatives from lTD and the City of Moscow will also be in attendance to assist in the meeting. Page 6 of 10 8/10/2007 ---PAGE BREAK--- If a Public Hearing is required, the City of Moscow and lTD will arrange to have a Hearing Officer at the Public Meeting and advertise according to the Design Manual. 4.12 Analyze Public Meeting Comments Upon completion of the meeting, the City of Moscow will review comments, and analyze the concerns expressed by the public. A wTitten response addressing significant comments will be prepared by the City of Moscow. 4.13 Location/Design Study Report The Location/Design Study Report, along with the required attachments, will be completed and submitted for Design Approval. It is anticipated that a Waiver of Public Hearing will be issued. 4.14 Flood Plain Location Riedesel Engineering will locate Paradise Creek's flood plain boundary and elevation based on FEMA maps. Task 5- Final Design 5.1 Prepare Final Design Plans: Riedesel Engineering will prepare the final design plans for portions of the project. The final design plan will include, construction traffic control plan sheets, developed in accordance with the MUTCD and the lTD Design Manual. Prepare Pathway Plan & Profile Plans Pathway plans sheets depicting alignments, widening, construction and removal items, drainage, profiles and other details will be completed. Prepare Intersection Details Intersection plans will be prepared by Riedesel Engineering detailing ADA compliant pedestrian crossings at the intersections of Blaine Street and Styner Street. Prepare Landscaping Plans Riedesel will prepare Landscaping Plans based on City of Moscow's design. Prepare Illumination Plans Riedesel will prepare Illumination Plans depicting the layout of illuminares along the pathway. The Illumination Plans will also detail wire design and electrical service design based on electrical subconsultant's design. Prepare Pavement Marking/Signing Sheet Prepare Sign Summary Sheet Prepare Construction Traffic Control Plans Riedesel Engineering will prepare Construction Traffic Control Plans in conjunction with the anticipated construction sequencing to build the project. 5.2 Calculate Final Quantities: Final US Customary quantity estimates will be prepared and checked before being added to the summary sheets. Pavement section quantities will be calculated off the typical sections. 5.3 Prepare Special Provisions Special provisions required for properly constructing the pathway will be prepared. 5.4 Prepare Construction Cost Estimates Estimated unit costs will be multiplied with the calculated pathway quantities using the "Estimator" computer program to develop an estimate of the construction cost. The unit costs will be reviewed and adjusted based on recent ITD unit bid prices and knowledge of local construction methods and costs. 5.5 Estimate Contract Time Key# 09756 Page 8 of 10 8/10/2007 ---PAGE BREAK--- The construction time will be estimated based on lTD's manual titled "Contract Time Determination in Project Development" and the Microsoft Project Scheduling program. 5.6 Storm Water Pollution Prevention Plan items will be shown as details on the plan set. Special Provision items will be added to the proposal during the design process, if required. 5. 7 Final Plan Assembly and Review Final construction documents will be assembled and reviewed in-house, then submitted to the City of Moscow and lTD for review. The lead-time will be agreed upon in advance to accommodate the final design review conference. 5.8 Design Approval and Hearing Waiver Riedesel will prepare a one-page letter for the City requesting Design Approval and Public Hearing Waiver (if appropriate). 5.9 Final Design Review Attendance The final design review meeting will be attended by key project team members. Minutes will be prepared summarizing the review comments and discussions from this meeting. A master mark-up of the design plans and specifications will be developed incorporating the final design review comments. 5.10 Consultation and Meetings Periodic project review meetings and correspondence will be continued throughout the final design phase. Task 6- PS&E Submittal 6.1 Final Plan Revisions Required changes to the project plans will be made following the final design rev1ew·. 6.2 Final Quantity and Estimate Changes Required changes to the quantities and estimates will be made following the final design review. 6.3 Final Special Provision Changes Required changes to the special provisions will be made following the final design review. 6.4 Final Changes Required changes to the will be made following the final design review. 6.5 Resident Engineer's File Key# 09756 Page 9 of 10 8/10/2007 ---PAGE BREAK--- Pertinent data from the design, materials, and environmental phases of the project will be compiled into a single file for use by the Resident Engineering Staff during the construction of the project. 6.6 Submit PS&E Package The consultant team will submit the contract documents to ITD for review and advertisement. 6.7 Consultation and Meetings Periodic project review meetings and correspondence will be continued throughout the PS&E design. Task 7- Project Management and Coordination The enhancement project studies and design is anticipated to require 10 months to complete. 7.1 Pre-Operation Conference The Project Manager will meet at ITD with the City of Moscow at a pre-operation conference to discuss the project scope of work, schedule, and issues of concern. 7.2 Prepare Progress Reports Progress reports will be prepared and include lTD Form 771, the current PSA, the current invoice, applicable back up and a cover letter. 7.3 Project Administration The project budget will be monitored, the project files will be set up and maintained, and the project team will be coordinated throughout the project design.
