Mission SCOAP ProposallO Safe Community Offender Accountability Program Protocol and Memorandum of Understanding The mission of this program is to protect and enhance public safety and promote better outcomes for offenders, their at-risk children and their families. The proactive management of offenders living or working in our community is accomplished through the combined application of sharing information, applying sanctions, supervision and provided services. The management process is designed to control the likelihood of people re-offending. Nothing in this protocol is intended to reduce the responsibility of the Idaho Department of Correction to supervise or provide treatment to people under their control. Purpose The purpose of our partnership is to properly manage offenders who live and work within our community, to promote better outcomes for the offender and their families, and to protect the public from the improper and illegal activities of the offender. Goal The goal of the Moscow Police Department and District 2 Probation and Parole is to make sure offenders comply with the terms of their probation or parole, court ordered stipulations and to prevent recidivism. In this way, the outcomes for the offender and the offender's family will be improved. The intent of the program is to assist the offender in successful completion of his/her probation or parole by sharing information, applying sanctions, supervision and to assist the offender in obtaining community services. High-risk offenders, sex offenders or high profile cases are not the only people that these program resources should be directed toward. Medium risk offenders that are continuing to cause frequent problems should also be addressed. ---PAGE BREAK--- SCOAP Proposal 11 Community Oriented Policing Approach The team concept will be used to identify problem offenders and keep them in compliance with their restrictions. A team is normally described as one Probation and Parole Officer and one Moscow Police Officer working together, under a Supervisor or Designee's direction, to meet the goal and purpose of this program. Members of the team will be assigned and will receive specialized training before they are allowed to work in this program. Each team will complete a daily activity log. The intent is to direct the resources of this program to people that are identified by Supervisors/Designee's. Listed is a non-inclusive example of where the resources may be directed: 1. High profile/problem Parole/Probationers. 2. Domestic batterers 3. Sex offenders 4. Civil Protection or No Contact Orders 5. Outstanding warrants on problem offenders 6. Nuisance Offenders 7. Community Events 8. Other offenders/incidents that Supervisors feel could be resolved by the offered resources. Collaborative supervision is the intention. While arrests on new charges are acceptable, the intent of the SCOAP program is to require compliance with court orders and hold offenders accountable for their actions. The goal will be met by increasing the flow of information between the departments and having highly visible, uniformed teams working together on a scheduled basis. The teams, with involvement from the assigned Supervisors/Designees, will identify offenders for special review and monitoring. This program is intended to be highly visible within the community. Presentations will be made whenever possible to increase public awareness of the program. ---PAGE BREAK--- SCOAP Proposal12 The team may be allowed to use cover surveillance tactics to monitor an offender(s). The Moscow Police Department will select a supervisor(s)/designee to be responsible for the supervision/oversight of Officers conducting the SCOAP program. The Idaho Department of Correction will select a supervisor/designee to be responsible for the supervision/oversight of the Probation and Parole Officers. Participation in Home Visits According to state statute and existing case law, a warrantless search may be conducted by probation or parole officer(s). In regard to this protocol, the only personnel who are allowed to make the decision to conduct a search involving people under the control of the Idaho Department of Correction will be the Idaho Department of Correction Probation and Parole Officers and/or I DOC Supervisors/Designees. An exception to this rule is if an emergency occurs and exigent circumstances require action to be taken to protect life or property. Moscow Police Officers may be utilized to assist in the search or provide additional support, as requested by the Probation and Parole Officer. Participation in Police Duties Recognizing the small community we live in, it will be inevitable that the SCOAP team will need to be available to occasionally respond to calls or other police duties. Nothing in this document precludes that ability. However, it is the stated intention that the primary purpose of this program is offender supervision. Assigning a SCOAP team a "beat" is strongly discouraged. It is one of the stated goals of this program to increase public protection. In line with that goal, it is encouraged to have the SCOAP team regularly assigned a list of sex offenders to verify addresses on the Idaho Sex Offender Registry. In such cases, the Moscow Police Officer shall be the lead officer with the Probation and Parole officer taking his/her direction from the Moscow Police Officer. This shall be the procedure for all police duties outside of supervision related functions. ---PAGE BREAK--- SCOAP Proposal13 Annual Review and Update In order to continue an effective working partnership, representatives from both agencies may conduct an annual objective review of the program and of the protocol. This agreement may be suspended or terminated at any time, and for any reason, by the signatories or their successors by submitting their intentions in writing. A modification of the agreement may be approved by both parties verbally at any time. Through our partnership, we recognize the vital role that the Moscow Police Department and the Idaho Department of Correction can play in keeping our community safe. The signatories below have reviewed the Safe Community Offender Accountable Program Protocol. We approve and agree to abide by the provisions as stated in the program document.
