PARTIES ADDENDUM NO. 2 TO STATE/LOCAL AGREEMENT (PROJECT DEVELOPMENT) STP-M-7564(004) A STREET, STAGE 2, MOSCOW LATAH COUNTY KEY NO. 03546 THIS ADDENDUM NO. 2 TO STATE/LOCAL AGREEMENT (PROJECT DEVELOPMENT) STP-M-7564(004) A STREET, STATE 2, MOSCOW, LATAH COYNJZ KEY NO. 03546 (hereinafter 'Adden&um' ) is made and enteted into this Q? 1 day of , , by and between the IDAHO TRANSPORTATION DEPARTMENT, hereafter called the STATE and the CITY OF MOSCOW, acting by and through its Mayor and Council, hereafter called the SPONSOR. PURPOSE This Addendum No. 2 shall modify the State/Local Agreement (Project Development) STP-M-7564(004) A Street, State 2, Moscow, Latah County, Key No. 03546 entered into on the 6th day of July, 2004, (hereinafter "Agreement") between the same parties. The parties agree to the following revisions: A. Section I, Paragraph 3 of the Agreement shall be amended to read as follows: 3. The SPONSOR'S match for this project shall be provided as follows: a. Cash; and b. Costs incurred by the SPONSOR to purchase right-of-way for the project that exceed the funds scheduled for right-of-way purchases. B. All other terms and conditions previously agreed to and set forth in the Agreement shall remain in full force and effect. Witness my hand and official seal this 23 rd day of October, 2012. ---PAGE BREAK--- RESOLUTION NO. 2012- 15 A RESOLUTION OF THE CITY OF MOSCOW, IDAHO, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AGREEING TO ADDENDUM NO. 2 TO STATE/LOCAL AGREEMENT (PROJECT DEVELOPMENT) STP-M-7564(004) A STREET, STAGE 2, MOSCOW, LATAH COUNTY KEY NO. 03546; PROVIDING THAT THIS RESOLUTION TO BE EFFECTIVE UPON ITS PASSAGE AND APPROVAL. WHEREAS, the Idaho Department, hereafter called the STATE, has submitted an Addendum to the Agreement stating obligations of the STATE and the CITY OF MOSCOW, IDAHO, hereafter called the CITY, for development of A Street, Stage 2, Moscow; and WHEREAS, the STATE is responsible for obtaining compliance and laws, standards and procedural policies in the development, construction and maintenance of improvements made to the Federal-Aid Highway System when there is a federal participation in the costs; and WHEREAS, certain functions to be perfonned by the STATE involve the expenditure of funds as set fmth in the Agreement; and WHEREAS, the STATE can only pay for work associated with the State Highway system; and WHEREAS, the CITY is fully responsible for its share of project costs; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Moscow, Idaho as follows: 1. The Addendum to the Agreement for Federal Aid Project STP-M-7564(004) is hereby approved. 2. That the Mayor and City Clerk are hereby authorized to execute the Agreement on behalf of the CITY. 3. That duly certified copies of the Resolution shall be furnished to the Idaho Transportation Department.
