AGREEMENT TO HOLD HARMLESS This Agreement is entered into this _I _day 1995, by and between David Peckham, and the City of Moscow, a municipal corporation of the State of Idaho (hereinafter, CITY); WITNESSETH WHEREAS, David Packham has requested that he be allowed to remove bicycles and bicycle parts from the solid waste stream generated from the City of Moscow and which is processed at the Latah Sanitation Transfer Station for the purpose of repairing such bicycles and providing them to the youth of the City of Moscow and Latah County; and WHEREAS, The City desires to encourage David Peckham in recycling and reuse of such bicycles and parts for the benefit of youth NOW THEREFORE, David Peckham hereby agrees as follows I. That David Peckham shall hold the City harmless for any and all liability and/or damages of whatever nature arising from David Peckham's activities, or the activities of anyone acting at his direction, in salvaging or removing bicycles and bicycle parts from the solid waste collected from the City of Moscow or processed at the Latah Sanitation Transfer Station. 2. That David Peckham shall not cause added labor or expense of the City of Moscow or Latah Sanitation by his salvaging of bicycles or bicycle parts. 3. That the term of this hold harmless provision shall be in effect for the duration of time the City allows David Peckham to engage in such salvage of bicycles and bicycle parts. 4. That the City may revoke this authority at its discretion without liability to David Peckham for such revocation.
